Six bids were received by the deadline of April 23, 2025. Woods Construction, Inc.$6,438,000 <br />Engineer’s Estimate $4,500,000 <br />Engineering and Transportation Department staff determined the low bid of $4,261,570 submitted by <br />JMB Construction, Inc., was non-responsible. The bid package submitted by JMB Construction, Inc. <br />showed an Interstate Experience Modification Rate (EMR) of 1.21. Section 00 4513 of the Project Manual’s <br />Attachment A – Statement of Qualification Questionnaire states that “[a] rating in excess of [1] may <br />constitute grounds for disqualification as non-responsible”. A higher EMR indicates a company received <br />more workers’ compensation claims than expected. The decision to reject JMB Construction, Inc. as non- <br />responsible is permitted under Section 00 2113 of the Project Manual’s Instruction to Bidders, item 3.01 <br />Part D, which provides in relevant part: <br />“If Apparent Low Bidder is determined to be non-responsive or non-responsible, then City may <br />proceed to the next Apparent Low Bidder’s Bid pursuant to any procedures determined in its <br />reasonable discretion, and proceed for all purposes as if this Apparent Low Bidder were the <br />original Apparent Low Bidder.” <br />6.F. - Page 3 of 5 <br />61
