Legal Authority <br />WDR REQUIREMENTS <br />Att. D-3 (pg. D-4) <br />“The Plan must include copies or an electronic link to the Enrollee’s current sewer system use ordinances, <br />service agreements and/or other legally binding procedures to demonstrate the Enrollee possesses the <br />necessary legal authority to: <br />• Prevent illicit discharges into its sanitary sewer system from inflow and infiltration (I&I); <br />unauthorized stormwater; chemical dumping; unauthorized debris; roots; fats, oils, and grease; <br />and trash, including rags and other debris that may cause blockages; <br />• Collaborate with storm sewer agencies to coordinate emergency spill responses, ensure access <br />to storm sewer systems during spill events, and prevent unintentional cross connections of <br />sanitary sewer infrastructure to storm sewer infrastructure; <br />• Require that sewer system components and connections be properly designed and constructed; <br />• Ensure access for maintenance, inspection, and/or repairs for portions of the service lateral <br />owned and/or operated by the Enrollee; <br />• Enforce any violation of its sewer ordinances, service agreements, or other legally binding <br />procedures; and <br />• Obtain easement accessibility agreements for locations requiring sewer system operations and <br />maintenance, as applicable. <br />COMPLIANCE <br />The City’s Municipal Code (“City Code”) describes the City’s legal authority required for compliance with <br />the WDR. That authority is generally contained within City Code, Chapter 27- Sanitary Sewerage Facilities, <br />although other sections also contain the legal authority necessary to regulate the sanitary sewer system. <br />The City’s Engineering Standards also includes requirements that provide additional legal authority. With <br />regard to the industrial pre-treatment program, legal authorities are found in the Silicon Valley Clean Water <br />Joint Powers Agreement. These three codes may be accessed at: <br />• City Code <br />• Engineering Standards <br />• SVCW Joint Powers Agreement <br />The above items are addressed in order below: <br />a. The authority to prevent illicit discharges is found in: <br />• City Code, Sections 27.10-14, 13, 27.32.4, and 41.19, <br />• SVCW joint powers agreement, Sections 7.4 and 7.6.. <br />The authority to limit the discharge of fats, oils, and grease and other debris that may cause <br />blockages is found in the City Code Section 27.13. <br />The requirement to control infiltration and inflow (I/I) from private service laterals is found in the <br />City Code Section 27.11 and Volume 1, Section 02730 of the Engineering Standards. <br />The authority to implement an Industrial Pretreatment Program is found in the Regulations of <br />Silicon Valley Clean Water, Sections 1.3.9, 4.2, 4.4, 4.8, and 4.10. <br />ATTY/RESO.0077/CC RESO SEWER SYSTEM MANAGEMENT PLAN - EXHIBIT A <br />REV: 07-14-25 LF <br /> <br />Page 29 of 317
