Consider future agreement with Outfront-Foster Interstate (O/FI) on potential placement of a digital billboard at 350 Convention Way (304) Assistant City Manager Patrick Heisinger gave a presentation. The following members of the public provided comments: • Alex Belenson • Wade Painter Recommendation: 1. By motion, authorize staff to prepare and sign a Letter of Intent (LOI) with O/FI to confirm the City’s interest in considering a digital billboard at 350 Convention Way; 2. By motion, authorize staff to negotiate terms for a digital billboard agreement, should the City Council ultimately approve the billboard at that location; and 3. By motion, direct staff to return to the City Council at the end of the negotiation and, if staff recommends moving forward with agreed-upon terms, to prepare the agreement and amendments to the City's sign ordinance that would allow for the installation of a digital billboard at that location. CEQA: The City Council’s action to direct staff to revise the Sign Ordinance and negotiate with O/FI is not a project under CEQA as defined in CEQA Guidelines Section 15378 because it is an administrative action and not a “project” that could directly or indirectly impact the environment. However, if staff successfully negotiate an agreement, appropriate CEQA review would be required for its approval and/or to proceed with changes to the sign ordinance and the placement of the billboard.
