Directed staff to return to the City Council with a proposed Memorandum of Understanding with the County of San Mateo that would memorialize the roles and responsibilities of both parties on enforcement of the Ordinance. During the City Council meeting on July 21, 2025, many of the public comments and the City Council discussion focused on three topics: (1) The City’s relationship with the County of San Mateo regarding implementation of the Ordinance; (2) Ways to better protect the City’s waterways; and (3) A desire to establish an ongoing City Council Sub-Committee on Homelessness. Since the July 21, 2025 meeting, staff has been working with the County of San Mateo on the proposed MOU and conducting additional research on designating waterways as a Sensitive Area. Through this work, staff determined and recommends that the Ordinance presented on July 21, 2025 be modified and reintroduced to (1) add waterways as a Sensitive Area and (2) provide the County of San Mateo the authority to conduct all aspects of enforcement. In addition, staff recommends establishing a City Council Sub-Committee on Homelessness. ANALYSIS Modified Anti-Camping Ordinance (Ordinance) The proposed changes to the Ordinance (Attachment A) are (1) to add waterways as a Sensitive Area and (2) authorize the County to conduct all aspects of enforcement. Including Waterways as a Sensitive Area The following language was added to Section 49.1 (d) of the Ordinance: Any waterway, bank of a waterway, tributary of a waterway, estuary or wetland. Waterway means any natural or artificial channel, stream, river, creek, canal, drainage ditch, or other conduit—whether intermittent or continuous—that carries or is capable of carrying surface water, including but not limited to Redwood Creek, Cordilleras Creek, Bayfront Canal, and Redwood Shores Lagoon. This includes the banks, beds, and adjacent riparian zones of such channels. For the purposes of this ordinance, waterways also include areas designated for stormwater management or flood control, and any location within 75 feet of the edge of a waterway, where human activity may pose a risk to water quality, ecological integrity, or public safety.
