HHCC’s recommendation. <br />Staff Recommendation for Right to Return <br />Based on the information outlined in Attachment F and the recommendations from the HHCC, staff <br />recommends that the City Council approve the inclusion of a right to return policy in the TPO that includes <br />the following: <br />When a substantial remodel of a rental unit is completed, a landlord will be required to offer the tenant <br />the first right to return to the rental unit with the following provisions: <br />1) The offer to return must be at the rental rate that was in effect when the tenancy was terminated <br />plus any increase(s) allowed by the TPA, had the tenant continuously occupied the rental unit. <br />2) The offer to return must include a lease that contains the same terms as the lease that was in <br />effect at the time the tenancy was terminated, except for any changes to terms required by <br />federal, state or local law. <br />3) Notices: <br />a. Landlords must notify tenants within 10 calendar days of the unit being ready for re- <br />occupancy. <br />b. Tenants must notify landlords their intent to return within 30 calendar days <br />c. Tenant must re-occupy the unit within 30 calendar days of notifying the landlords7 <br />The TPO also includes the right for landlords to appeal to the City Manager in cases where a landlord <br />believes that the City’s right to return policy will not allow them to recover a fair rate of return on their <br />investment. This appeals process will be further outlined in the administrative guidelines staff will be <br />drafting. <br />7 The staff recommended noticing requirements are slightly different than the recommendations from the HHCC, <br />but they both provide an overall 60 day timeline between a tenant notifying a landlord of their intent to return to a <br />unit, and the date which they must move back into the unit.
