This law allows certain affordable housing <br />developments that meet specific eligibility criteria to submit a preliminary application that will lock in the <br />applicable regulations. Those eligibility criteria require the project to contain residential units (including <br />mixed-use developments with at least two-thirds residential space) and to comply with objective zoning <br />and design standards. This project appears eligible for SB 330 protection as it is a 100% affordable housing <br />project intended for residents age 55 and older, however staff will need to review the preliminary <br />application and project site in more detail to ensure the site meets all of eligibility criteria. The preliminary <br />application ensures stability for land use regulations and streamlines the entitlement process for the <br />project. The Applicant must submit a full development application within 180 days of the preliminary <br />application submission. <br />This required public meeting will function similarly to a study session and allow the public and the City <br />Council an opportunity to comment on the proposed project; however, no formal decision will be made <br />on the project at the meeting. The project must still go through the development review process once the <br />Applicant submits the full application to ensure it meets objective City standards and requirements except <br />where those standards and requirements are modified by any allowable waivers or concessions <br />authorized under the State Density Bonus law. The meeting will include presentations by staff and the <br />Applicant followed by an open public comment period. City Council members may ask clarifying questions <br />of the Applicant and may also comment generally on the project. State law requires the applicant to <br />9.A. - Page 4 of 7 <br />428
