Final acceptance of the Seaport Centre Levee Improvements and the Seaport Plaza <br />Levee Improvements, summary vacation of portions of the easement formerly known <br />as Seaport Levee, and the Second Amendment to the Levee Financing and <br />Improvement Agreement (506) Reso 16359 <br /> Reso 16360 <br /> Reso 16361 <br /> <br />Recommendation: <br />1. Adopt a resolution accepting as complete the Levee and Related Flood Protection <br />Facilities on Seaport Plaza and the Modified Levee and Related Flood Protection Facilities <br />on Seaport Centre ; <br />2. Adopt a resolution summarily vacating a portion of the easement for maintenance of <br />the Seaport Centre Levee pursuant to Part 3 of Division 9 of Chapter 4 of the California <br />Streets and Highways Code; and <br />3. Adopt a resolution approving a Second Amendment to Levee Financing and <br />Improvement Agreement among the City of Redwood City, HCP LS Redwood City, LLC, <br />Metropolitan Life Insurance Company, and Seaport Centre Owners’ Association. <br /> <br />CEQA: <br />This activity is not a project under California Environmental Quality Act (CEQA) as defined <br />in CEQA Guidelines, Section 15378, because it has no potential for resulting in either a <br />direct or reasonably foreseeable indirect physical change in the environment. This <br />activity simply authorizes acceptance of facilities that have been constructed in <br />accordance with the LFIA, as authorized on October 26, 2020, and the Second <br />Amendment to the LFIA authorizes use of funds for certain maintenance activities <br />contemplated by the CFD rate and method incorporated in the CFD formation resolution. <br />Moreover, on October 26, 2020, the City Council determined that Seaport Levee <br />Improvements were categorically exempt from the requirements of the California <br />Environmental Quality Act (“CEQA”) pursuant to State CEQA Guidelines, 14 CCR §§ <br />15000, et seq., Sections 15301 (Class 1. Existing Facilities), 15302 (Class 2. Replacement <br />or Reconstruction), 15304 (Class 4. Minor Alterations to Land), and 15311 (Class 11. <br />Accessory Structures). A Notice of Exemption was filed on February 4, 2021. <br /> <br /> <br /> <br />
