Page 2 of 4 <br />City of Redwood City 1017 Middlefield Road, Redwood City, CA. 94063 Tel: 650-780-7000 www.redwoodcity.org <br />BACKGROUND <br />RethinkWaste <br />The City is one of eleven member agencies of the Joint Powers Authority, South Bayside Waste <br />Management Authority (SBWMA aka RethinkWaste). RethinkWaste was formed in 1982 and is governed <br />by a Board of Directors comprised of one elected official from each member agency; Council Member <br />Sturken currently serves on the Board for the City. In addition to owning and managing Shoreway <br />Environmental Center, RethinkWaste assists its member agencies with “strategic oversight, support and <br />management of the service providers that collect, process, recycle and dispose of materials on behalf of <br />RethinkWaste.”1 <br />Recology San Mateo County (Recology) <br />Each of the eleven RethinkWaste member agencies has an agreement with Recology to provide collection <br />services for solid waste, which includes garbage, recyclables, and organic materials. The original term of <br />the agreement between Recology and the City was from January 1, 2011 through December 31, 2020. In <br />2018, the City and Recology entered into an Amended and Restated Franchise Agreement that extended <br />the term of the agreement for an additional fifteen years, through December 31, 2035. <br />ANALYSIS <br />Amendments to Chapter 14 of the Redwood City Municipal Code <br />The proposed amendments to Chapter 14 (Refuse, Weed, Nuisance and Abandoned Shopping Cart <br />Regulation and Abatement) include changes to: <br />1. Allow a waiver from the current requirement to have refuse service at an occupied premise, <br />2. Allow for private disposal (i.e., self-hauling) of refuse, and <br />3. Section 14.31 to allow for Recology to assume billing responsibilities and to state that maximum rates <br />charged by any Refuse Collector shall be approved by resolution of the City Council. <br />Currently, Section 14.2 of the Municipal Code requires that all occupied premises shall have refuse service. <br />The proposed amendments would allow for an exception to this requirement (in the form of a waiver) <br />provided that the person requesting the exception can show that it will not adversely affect the <br />“sanitation of the City and the preservation of the health of the inhabitants.” <br />Proposed changes in Section 14.22 would allow a person to self-haul any refuse they generate, assuming <br />they meet the conditions of maintaining a self-haul permit. These proposed changes would give an <br />additional option to refuse generators beyond subscribing to service directly with Recology.
