iii. Business Automobile Liability Insurance. Habitat shall maintain coverage using ISO Business Auto Coverage form CA 00 01 (or equivalent), with limits not less than $2,000,000 each accident combined single limit for owned or scheduled, and hired and non -owned automobiles. The scheduled autos coverage shall provide and be endorsed that the Borrower and the Lender, its Council, officers, boards, officials, commissions, agents, employees, and volunteers are included or named as additional insureds. iv. Workers' Compensation and Employer's Liability Insurance. Habitat shall maintain coverage as required by the California Labor Code of Workers' Compensation and Employer's Liability Insurance with limits not less than $1,000,000 each accident for bodily injury or disease. The Worker's Compensation policy shall contain an endorsement stating that the insurer waives any right to subrogation against the Borrower, the Lender, its Council, officers, boards, officials, commissions, agents, employees, and volunteers. The Workers' Compensation and Employer's Liability Insurance will not be required if Habitat has no employees and provides, to the Borrower's and Lender's satisfaction, a written declaration stating this. V. Professional Liability Insurance. For design or engineering services or work provided hereunder, Habitat shall ensure that its Subcontractor shall maintain insurance coverage that insures against professional errors and omissions that may be made in performing professional services with limits not less than $1,000,000 per claim and in the aggregate. Professional Liability may be written as claims - made coverage. Any policy inception date, continuity date, or retroactive date must be before the effective date of the start of work, and Subcontractor agrees to maintain continuous coverage through a period no less than three (3) years after completion of the work. b. Notice of Cancellation, This insurance will be in force during the life of the Agreement and any extensions of it and will not be modified or canceled without Habitat providing thirty (30) days prior written notice to Borrower and Lender sent pursuant to the Notice provisions of this Agreement. C. Providing Certificates of Insurance and Endorsements. Prior to Lender's execution of this Agreement, Habitat shall provide to Borrower and Lender certificates of insurance and above -referenced policy endorsements sufficient to and in accordance with this Agreement. In no event shall Habitat commence any work or provide any services under this Agreement until certificates of insurance and endorsements have been accepted by Borrower and Lender. d. Failure to Maintain Coverage. If Habitat fails to comply with these insurance requirements, then Borrower will have the option to declare Habitat in breach.
