REV: 11-21-25 LF <br />(4) Attendance at a progress meeting by a Consultant’s subconsultant <br />does not constitute a site visit. To be considered a site visit, the <br />Consultant’s subconsultant must perform close-up observation of <br />the relevant work being constructed, review the Contractor’s As- <br />Built Documents, and prepare and submit a site visit report to City <br />Staff. <br />3.Communications. All written communications with the Contractor must be <br />through City Staff unless otherwise approved in writing by City Staff. <br />4.Interpretation of the Contract Documents <br />a.Consultant must provide all design-related technical interpretation of <br />the Contract Documents during construction necessary for the proper <br />execution and progress of the relevant scope of work; <br />b.Interpretations and decisions of Consultant must be consistent with the <br />intent of and reasonably inferable from the Contract Documents and <br />must be in written and/or graphic form. <br />c.For Requests For Information (RFIs), Consultant responses to RFIs <br />must be in the form of drawings, sketches, technical information, and/or <br />any other documentation, in sufficient detail for the Contractor to <br />proceed unimpeded without requesting further clarification; <br />(1) Consultant shall bear the cost of responding to RFIs; however, if, as <br />a result of the RFI, City Staff directs a change to the Project scope, <br />the implementation of which requires preparation of design <br />documents by Consultant, City Staff may negotiate a corresponding <br />fee increase; <br />(2) In preparing its response to any RFI, Consultant will evaluate <br />whether the response will result in a change to the requirements of <br />the Contract Documents. <br />(3) If Consultant’s response to a RFI will change the requirements of <br />the Contract Documents, Consultant must: <br />a)State in writing in Consultant’s response to the RFI that the <br />response to the RFI is a change to the requirements of the <br />Contract Documents; and, <br />b)Promptly notify City Staff that the Consultant’s response to the <br />RFI is a change to the requirements of the Contract Documents. <br />(4) Consultant will be required to prepare a cost estimate for each <br />change to the Contract Documents resulting from Consultant’s <br />response to a RFI; and, <br />(5) Upon City Staff’s request, Consultant may be required to assist City <br />Staff in negotiating any adjustment in the Contract Time or Contract <br />Sum with the Contractor resulting from contract modifications based <br />on Consultant’s response to a RFI. <br />d.For Claims, Disputes, and other matters in question between City Staff <br />and Contractor, Consultant must render written <br />opinion/recommendation within fourteen (14) City Business Days. <br />e.Consultant must notify City Staff immediately if more time is required, <br />for reasonable cause, to respond to RFIs, Claims, or other matters.
