ELECTRIC MOBILITY DEVICE, NON-MOTORIZED MOBILITY DEVICE, AND BICYCLE REGULATIONS Sec. 8.1. – PURPOSE The purpose of this Article is to regulate the personal use of electric mobility devices, non- motorized mobility devices, and bicycles within the City limits of Redwood City. The City supports the use of electric and non-electric bicycles and other personal mobility devices as alternate modes of transportation, while also recognizing the need to provide the regulations necessary for the protection of public safety. Nothing in this Article is intended to restrict or otherwise regulate the use of personal motorized or non-motorized assistive devices, such as a wheelchairs or other similar devices, by persons with mobility disabilities in accordance with the Americans with Disabilities Act (42 U.S.C. Section 12101 et seq.) and Section 36.311 of Title 28 of the Code of Federal Regulations. Sec. 8.2. – DEFINITIONS The following definitions apply to this Article. Unless expressly provided in this Chapter, the definitions from the California Vehicle Code apply, as may be amended from time to time. A. “Bicycle” has the same meaning as in California Vehicle Code Section 231 and means a device upon which a person may ride, propelled exclusively by human power, except as provided in California Vehicle Code Section 312.5, through a belt, chain, or gears, and having one or more wheels. An electric bicycle is a bicycle. B. “Electric Bicycle” has the same meaning as in California Vehicle Code Section 312.5 and means a bicycle equipped with fully operable pedals and an electric motor that does not exceed 750 watts of power. 1. “Class 1 electric bicycle,” or “low-speed pedal-assisted electric bicycle,” is a bicycle equipped with a motor that provides assistance only when the rider is pedaling, that is not capable of exclusively propelling the bicycle, except as provided in paragraph (4), that ceases to provide assistance when the bicycle reaches the speed of 20 miles per hour, and that is not capable of providing assistance to reach speeds greater than 20 miles per hour. 2. “Class 2 electric bicycle,” or “low-speed throttle-assisted electric bicycle,” is a bicycle equipped with a motor that may be used exclusively to propel the bicycle, and that is not capable of providing assistance when the bicycle reaches the speed of 20 miles per hour. 3. “Class 3 electric bicycle,” or “speed pedal-assisted electric bicycle,” is a bicycle equipped with a motor that provides assistance only when the rider is pedaling, that is not capable of exclusively propelling the bicycle, except as provided in paragraph (4), and that ceases to provide assistance when the bicycle reaches the speed of 28 miles per hour, and equipped with a speedometer. C. “Electrically motorized board” has the same meaning as in California Vehicle Code Section 313.5 and means any wheeled device that has a floorboard designed to be stood upon when riding that is not greater than 60 inches deep and 18 inches wide, is designed to transport only one person, and has an electric propulsion system averaging less than 1,000 watts, the 9.A. - Page 7 of 10 782
