The agreement shall be in a form acceptable to the City Attorney and the <br />Engineering & Transportation Director. [Section 29.4C of Municipal Code][SDR] <br />E4 Stormwater Treatment Measures Maintenance Agreement. Enter into a Stormwater Treatment Measures Maintenance <br />Agreement for all on-site and off-site stormwater treatment measures associated with the project. The agreement shall be in a <br />form acceptable to the City Attorney and the Engineering & Transportation Director. [Section 27A.38 of Municipal Code][SDR] <br />Prior to Final Map <br />approval <br />E5 Subdivision Improvement Agreement. Enter into an Improvement Agreement to guarantee the installation of all improvements <br />required of the project and to provide for payment of all City inspection and plan check charges associated with the installation <br />of public and private improvements, including, but not limited to, streets, sanitary sewers, water, storm drains and streetlights. <br />The agreement shall be in a form acceptable to the City Attorney and the Engineering & Transportation Director. [Section 30.53 <br />/ Section 29.95 of Municipal Code][SDR] <br />Prior to Final Map <br />approval <br />E6 Conditions, Covenants, and Restrictions. Submit the project’s CC&Rs for review and approval to the Engineering and <br />Transportation Department. The CC&Rs shall describe obligations for maintenance of and access to shared utilities, stormwater <br />treatment facilities as described in the Stormwater Treatment Measures Maintenance Agreement, surface improvements, <br />landscaping and frontage improvements as described in the Landscape Maintenance Agreement, the shared private roadway, <br />and other common areas. The CC&Rs shall also provide reference to the HOA Budget, which shall include proposed level of <br />maintenance for activities described. All property owners must be members. The CC&Rs shall be in a form acceptable to the <br />City Attorney and the Engineering & Transportation Director. [COA] <br />Prior to Final Map <br />approval <br />E7 Bicycle Parking. Designate 11 short-term (visitor) and 32 long-term (tenant) bicycle storage spaces in accordance with the <br />approved plans. [Section 30.6 of Zoning Code][SDR] <br />Prior to Building <br />Permit Issuance <br />E8 Transportation Demand Management Plan. Submit a final Transportation Demand Management (TDM) plan for approval by <br />the City’s TDM Manager and provide a written description of how the plan will be implemented. [Section 48.5 of <br />Municipal Code][SDR] <br />Prior to First Certificate <br />of Occupancy <br />E9 Transportation Demand Management Implementation. The TDM plan referenced above shall include an annual reporting <br />requirement for the HOA for the life of the project. The HOA shall submit reports by January 31 of each year to the City’s TDM <br />Manager. Failure to comply with annual implementation requirements may result in enforcement action. Include data on public <br />parking usage within the annual TDM report. [Section 48.8 of Municipal Code][SDR] <br />Ongoing <br />E10 Repair or Replace Street Infrastructure. Restore streets surrounding the project site for any damage caused by the project to <br />the satisfaction of the City Engineer at project completion. When this requires additional pavement restoration, the City <br />Engineer or designee shall approve the preferred layout of pavement markings and any other elements such as bicycle facilities, <br />pedestrian facilities, complete street designs, etc. [Section 29.12 of Municipal Code][SDR] <br />Prior to Final <br />Certificate of <br />Occupancy <br />E11 Reconstruction of Frontage Streets. Submit plans showing reconstruction and restoration of frontage streets including <br />pavement and striping along Marshall and Broadway streets fronting the project site to the satisfaction of the City Engineer.
