ATTY/RESO.0126/PC RESO 1320 MARSHALL STREET PROJECT <br />REV: 12-10-25 VR <br />Page 6 of 7 <br />The project would not cause substantial environmental damage or substantially <br />and avoidably injure fish or wildlife or their habitat as it is located in an urban area <br />on a developed lot. <br /> <br />A CEQA Memorandum was prepared for the project which found that the project <br />is exempt from CEQA review pursuant to Section 15332 (Infill Development <br />Projects) of the CEQA Guidelines. The CEQA Memorandum included a checklist <br />analyzing whether the Project meets the criteria to qualify for the Class 32 <br />exemption and presented substantial evidence that the Project met these criteria, <br />including that the Project is on a small site surrounded by urban uses and does not <br />contain any significant effects related to traffic, noise, air quality, or water quality. <br /> <br />D. The design of the subdivision or the type of improvements will not <br />cause serious public health problems. <br /> <br />The Project proposes a permitted land use which is found to not cause serious <br />public health problems. <br /> <br />Additionally, the CEQA Memorandum concluded the Project will not have any <br />significant impacts related to traffic, noise, air quality or water quality and therefore <br />would not cause environmental or other public health problems. <br /> <br />E. The design of the subdivision or the type of improvements will not <br />conflict with easements, acquired by the public at large, for access through <br />or use of property within the proposed subdivision, unless alternative <br />easements will be provided. <br /> <br />The proposed subdivision would not conflict with any easements, acquired by the <br />public at large, for access through or use of property within the proposed <br />subdivision. <br /> <br />F. The reasons submitted for the granting of any exceptions comply with <br />the requirements of Section 30.46. <br /> <br />No exceptions to the Subdivision Ordinance are requested. <br /> <br />Section 6. Affordable Housing Plan – The Planning Commission is able to make <br />the required findings for approval of the Affordable Housing Plan prepared in a manner <br />consistent with the requirements in Section 29.7 of the Affordable Housing Ordinance. <br />The Planning Commission finds that: <br /> <br />A. The proposed affordable units comply with the applicable standards in <br />Article 29, including, without limitation, the requirement that the affordable units be <br />made available for concurrent occupancy per Section 29.6B. <br /> <br />
