REV: 01-05-26 LR <br />E. Once equipment has been delivered to the project site, it is the Contractor’s <br />responsibility to protect the equipment from theft and damage until Final <br />Acceptance and to insure the stored equipment against risk of loss and damage. <br />Contractor is to replace any lost or damaged equipment at no additional cost to <br />the Owner. <br />F. Contractor is to be present to receive all equipment at deliver site or project site. <br />Owner is not to receive, unload, or otherwise participate in delivery of equipment. <br />1.13 WARRANTY <br />A. General: Equipment and installation (100% parts and labor) for two (2) years from <br />date of Final Acceptance by Owner or Owner’s Representative. System <br />maintained and serviced against all malfunctions due to manufacturing or <br />installation defects at no cost to Owner during warranty period, including <br />preventive maintenance per manufacturer's recommendations or as necessary <br />to keep equipment in good working order. Software support provided during <br />warranty period to include all software upgrades at no additional cost to Owner. <br />1. Warranty period commences after Contractor has demonstrated <br />satisfactory performance of a functioning MSM system and after the 30-day <br />Operational Test. <br />2. Maintain a log of all maintenance, preventive maintenance and repair work <br />performed under warranty and provide to Owner or Owner’s Representative <br />at end of warranty period. <br />B. Warranty response period: <br />1. Monday through Friday, 8:00 am to 5:00 pm Pacific Time excluding <br />holidays. <br />2. Response time from initiation of trouble call, to on-site response by qualified <br />service technician <br />a. Immediate telephone support available from 8:00 am – 5:00 pm <br />Pacific Time Monday-Friday. <br />b. Next-day on-site technical support no-later than 12 noon Pacific Time <br />the following weekday. <br />C. If Contractor is not available for the required response, Owner or Owner’s <br />Representative may affect repairs with no impact on warranty. Pre-qualify <br />appropriate Owner or Owner’s Representative to perform repairs and identify <br />types of repair each trained individual is qualified to perform after training of <br />Owner personnel. For clarity, repairs by Owner or Owner’s Representative are <br />not the standard, required form of service and support and are only expected to <br />be used seldom and at Owner’s discretion if Contractor is unable to meet the <br />service level agreements stated here and the nature of the failure warrants <br />immediate attention.
