REV: 02-06-26 MI <br />Rate Report <br />Consultant shall document the results of their analysis in a Rate Report, which shall be <br />provided for review in Word or Excel file format to the Public Works Director or their <br />designee(s). The documentation shall explain how the methodology complies with <br />Proposition 218, relevant court decisions, and other assumptions. Consultant shall revise <br />the Rate Report as necessary, based on input from staff and any appropriate policy <br />bodies. Following any final City comments, Consultant shall produce a Final Report in <br />PDF format. The Final Report shall be finalized by the Consultant prior to the mailing of <br />the Proposition 218 notice. <br />Implementation <br />Consultant shall revise (if necessary) the presentation made to the Utilities Sub- <br />Committee to present final findings and recommendations to the City Council. Consultant <br />shall be available upon the Public Works Director or their designees’ request to attend via <br />video conference 1) the City Council meeting to initiate proceedings to schedule a public <br />hearing and 2) the public hearing at the end of the 45-day protest period to answer <br />questions. The public hearing will be held in March 2027 so that rates can be effective <br />July 1, 2027. <br />Municipal Code Review <br />Consultant shall review and recommend changes to the appropriate chapter of the City’s <br />Municipal Code to reflect the rate changes, as applicable. <br />Review or Draft Responses to Objections and Protests <br />As requested by City staff, Consultant shall review or draft responses to objections and <br />protests to proposed rates. Consultant shall make edits to responses based on feedback <br />from City staff, if needed. As long as the objection is received no later than seven weeks <br />prior to the Public Hearing, Consultant shall provide draft responses a minimum of six <br />weeks prior to the public hearing. <br />Project Management <br />Consultant shall monitor schedules and budgets, conduct periodic status calls with City <br />staff regarding the progress of the project, coordinate efforts, and other issues, and <br />perform quality control checks to peer review analyses and work products. Consultant <br />shall also track progress by task to ensure the project is within budget. <br />Deliverables: Consultant shall provide: <br />•Bi-weekly staff status meetings and agendas <br />•Presentation and attendance for up to two Utilities Sub-Committee meetings <br />•Proposition 218 notice <br />•Rate Report <br />•Attendance for up to two City Council meetings to initiate a public hearing and the <br />Proposition 218 hearing itself <br />•Recommended Municipal Code changes <br />•Responses to objections and protests to rates <br />•Monthly invoices <br />ATTY/AGR.2026.032/HF&H Consultants, LLC (Sewer Rate Study 2026-2027) (Page 14 of 16)
