Program H4-5: SB 9 Zoning and Subdivision Ordinance Amendmentsa) Review the City’s Zoning Ordinance and Subdivision Ordinance and implement updates as needed to provide clarity and facilitate housing development under SB 9. These include adopting updated definitions, use regulations, development standards, and ministerial processes based on the outcome of a complete SB 9 analysis. Staff anticipates adoption of an ordinance to implement the requirements of SB 9 as part of the Housing Element adoption process. Production and affordability will be monitored every two years and alternative actions will be implemented if necessary to meet the RHNA.5/31/20236th CycleCompleteda) City amended the Zoning Code Article 5.10 and Municipal Code Article XII to implement the requirements of SB9.Effective as of 8/24/2023. In 2025, the City began drafting a package of zoning ordinance amendments that include provisions related to SB9 projects that would ensure consistency with State law requirements under SB 450, SB 477, and AB 1061. In Summer 2023 the City amended the "concurrent review" procedure of the Zoning Code to allow projects that need multiple permits to be reviewed by the highest review authority without first receiving recommendations and advisory input from committees or commissions. Effective as of 8/24/2023.In 2025, the City took numerous additional steps to streamline processes in order to facilitate residential development including: - Updated its planning submittal checklist with clearer objective submittal requirements in order to streamline completeness and development review. - Updated eTrakIt to allow online permit submittals and payment and to improve process transparency. The updates went live on smaller project types at the end of 2025 and it is anticipated that online submittal for residential project types will go live by summer of 2026. - Developed local checklists for housing pursuant to AB2011 and SB1123 - Developed local forms for fee deferral pursuant to SB937Also in 2025, City staff began drafting Zoning Ordinance amendments in 2025 that would further streamline the processing and review of housing development projects.
