REV: 2-24-26 LR <br />Department, in strict accordance with the provisions of this Agreement and <br />generally accepted accounting best practices. <br />7) Keep and maintain adequate internal controls to ensure that all daily fees to <br />which the City is entitled through the operation of the Garages are received, fully <br />accounted for, and remitted to the City. <br />8) Keep and maintain all books, records and accounts specified herein, and present <br />to the City all such records and reports on a monthly basis, as required by this <br />Agreement. <br />9) Maintain in accordance with recognized accounting practices and provide the <br />City unimpeded access online through the Ace platform, throughout the term of <br />this Agreement and for a period of three (3) years after the expiration or <br />termination of this Agreement, all records pertaining to revenues, Operating <br />Expenses (as defined by this agreement) and the Management Fee (as defined <br />by this agreement) for the term hereof. Upon reasonable notice to Consultant, <br />City Engineer or their designee may examine any of the Consultant's records <br />relating to the management and operation of the Garages, and shall have the <br />right to audit the same at any time during the term of this Agreement and for a <br />period of three (3) years after the termination or expiration of this Agreement. <br />The provisions of this Paragraph shall survive the expiration or termination of this <br />Agreement. <br />10) Operate and provide routine custodial maintenance of the Garages in <br />accordance with the provisions of a custodial plan to be provided to the City <br />Engineer within two weeks of execution of this agreement and approved by City <br />Engineer or their designee. <br />11) Maintain a good working business relationship with the City as the client and <br />owner of the Garages and keep the City Engineer or their designee current and <br />fully advised on all requests, complaints, or problems with any business entities, <br />customers, or other individuals or agencies, including the status of the parking <br />operations in general. <br />12) Obtain written prior approval from the City Engineer or their designee for any <br />special request for parking or parking fees, parking fee discounts, parking <br />validations, or any other arrangements or Agreements for additional services or <br />augmentations to the terms of this Agreement. <br />13) Meet with City Engineer or their designee as requested to inspect Garages and <br />confer on the status of operations and possible improvements, at least every two <br />weeks. <br />14) Do all other things necessary for the convenient, orderly, and efficient operation <br />of the Garages. <br />Expectations for Quality of Consultant’s Services Rendered <br />1) Ensure that customers receive consistently high levels of service and that they <br />experience no undue delays in entering or leaving the Garages.
