Waive the first reading and introduce the ordinance readopting the Military Equipment Use Policy; <br />and <br />3. Contingent upon adoption of the Military Equipment Use Policy, approve and authorize the City <br />Manager to execute a five-year First Amendment to the Purchase Agreement for Goods, <br />Commodities, and Services with Axon, in an amount not to exceed $3,700,000 over the five-year term, <br />for a revised total contract amount not to exceed $5,919,329, to provide a comprehensive hardware <br />and service package that modernizes and better integrates Department technologies, including <br />replacement and maintenance of BWC, unlimited digital evidence storage and management through <br />Evidence.com, expansion of the Department’s UAS program, implementation of a real-time <br />information platform (Fusus Pro+), and deployment of airspace monitoring and drone detection <br />infrastructure. <br />STRATEGIC PLAN GUIDING PRINCIPLE <br />Public Safety <br />BACKGROUND <br />This report is organized into two overarching categories to facilitate a clear and effective presentation of <br />information: <br />1. Review of the 2025 Annual Military Equipment Use Report and readoption of the Military <br />Equipment Use Policy; and <br />2. Consideration of a first amendment to the agreement with Axon to provide a comprehensive <br />hardware and services package to modernize and better integrate Department technologies. <br /> <br />Review of the 2025 Military Equipment Use Report and Readoption of the Military Equipment Use Policy <br />Assembly Bill 481, signed into law on October 8, 2021, and effective January 1, 2022, established <br />requirements for governing body approval and ongoing public reporting related to the use and acquisition <br />of military equipment by law enforcement agencies. The intent of the legislation is to enhance <br />transparency, accountability, and community oversight of military equipment use. <br />On June 26, 2023, the City Council adopted an ordinance approving a Military Equipment Use Policy <br />(Policy) pursuant to Assembly Bill 481 (AB 481) as codified in California Government Code sections 7070- <br />7075, which ordinance has been renewed and readopted annually and most recently on October 27, 2025. <br />These statutes require all California law enforcement agencies that own or are authorized to use <br />designated military equipment to comply with the following: <br />Maintain a Military Equipment Use Policy that describes each piece of military equipment the <br />agency has access to and the authorized uses for each piece of equipment. <br />9.A. - Page 2 of 197 <br />359
