If the owner or relative fails to move in within 90 days or reside in the <br />rental unit for at least 12 consecutive months and a new tenancy <br />commences either during the 90 day period in which the owner or <br />relative has to move in or the 12 month period in which the owner or <br />relative is required to occupy the rental unit, the rent for such new <br />tenancy is limited to the rent that was paid by the tenant who vacated <br />the rental unit for the owner move in. <br /> <br />d. Noticing Requirements: Per Section 45.5(B)(2)(a), the written notice <br />terminating a tenancy for an owner move-in must contain the following <br />information: <br /> <br />i. The name(s) and relationship(s) to the owner of the intended <br />occupant(s) <br /> <br />ii. A notification that, at the tenant’s request, the owner will provide proof <br />that the intended occupant is an owner or related to the owner <br /> <br />2. Withdrawal from rental market: Owner intends to permanently remove the rental <br />unit from the rental market in order to, for example, go out of business or use the <br />building for a purpose other than rental housing. The owner must remove all rental <br />units on the property from the rental market. <br /> <br />3. Compliance with a court order, government order such as when the building is <br />found to be unsafe or unhealthy for humans to live in, or local ordinance that requires <br />the rental unit to be vacated. An order to vacate does not automatically terminate the <br />tenancy. If a landlord wants to evict a tenant based on an order to vacate, the landlord <br />must first serve a notice of termination and provide relocation assistance. <br /> <br />o NOTE: If the tenant caused the condition(s) triggering the court or government <br />order to vacate, the tenant will not be entitled to receive relocation assistance. <br /> <br />4. Demolition: The owner intends to demolish the rental unit after obtaining all permits. <br /> <br />a. Noticing Requirements: <br /> <br />i. Per Section 45.5(B)(2)(e), landlords terminating a tenancy for a <br />demolition are required to provide a written notice terminating the <br />tenancy that includes the following information: <br /> <br />1.
