This notice must be sent to the landlord via certified mail, and a copy <br />of the notice and certified mail receipt must also be submitted to the <br />City Manager's Office through the online portal (preferred method), by <br />email, mail, or in-person. Please refer to Chapter 6 for more <br />information on the manner of service. <br /> <br />d. If the tenant accepts the offer to re-rent the rental unit, the tenant must <br />reoccupy the rental unit within 30 calendar days of notifying the landlord <br />of the acceptance of the offer. <br />e. The tenant must either sign a lease and/or pay the deposit prior to moving <br />into the rental unit if the landlord provides a copy of the lease. <br />How to calculate the Right to Return Rent <br />Example 1: <br /> - Substantial remodel work <br />took 6 months to complete <br /> <br />- Tenant’s rent at <br />termination - $2,120 <br /> <br />- Example Allowable <br />Tenant Protection Act <br />(TPA) Increase - 6% <br /> <br />Four months prior to terminating the tenancy, the landlord raised the <br />tenant’s rent to $2,120 the full 6% allowed under the TPA for the year <br />(previously the rent was $2,000). Since the rent was already increased <br />the maximum amount within a 12-month period (4 months prior to <br />termination + 6 months of remodel = 10 months), the Right to Return <br />Rent would be the same rental rate at the time the tenancy was <br />terminated. <br />Rent at Termination = $2,120 <br />Right to Return Rent= $2,120 <br />However, if the landlord had only done a partial increase prior to <br />terminating the tenancy (e.g., raising the rent 2% instead of the full 6% <br />allowed under the TPA) then the landlord could apply the remaining 4% <br />of the TPA increase to the Right to Return Rent offered to the tenant. <br />$2,000 X 2% increase= $2,040 (rent at termination) + $80 ($2,0000 x <br />4% remainder of TPA allowed increase) <br />Rent at Termination = $2,040 <br />Right-to Return Rental Rate= $2,120 <br />8.A. - Page 36 of 85 <br />294
