Page 5 of 12 <br />5/5/2026 <br />ATTY/DOCS-ORDINANCE-REGULATIONS/05-05-26 FAIR RATE OF RETURN APPEAL GUIDELINES AND APPEAL FORM <br />REV: 05-05-26 LF <br />10. The appeal officer may request additional information from the landlord. The landlord will be <br />required to submit such additional information within fourteen (14) calendar days of such <br />request. <br /> <br />11. Any additions to the information provided in the appeal may constitute good cause for the <br />appeal officer to delay the decision. <br /> <br />12. The appeal officer will make written findings of fact and issue a final written decision based <br />on the appeal filed and any additional information requested from the landlord. If the appeal <br />is granted, the decision will state the amount of the rent allowed to be charged to the <br />returning tenant that will enable the landlord to maintain a Fair Rate of Return. <br /> <br />13. After the appeal officer issues a decision, the City will deliver the notice of final decision to <br />the landlord by mail and provide a courtesy copy by email. <br /> <br />14. Landlords are required to notify the tenant of their right to return and the Fair Rate of Return <br />Rent (if approved) upon re-renting within ten (10) calendar days of the date of the notice of <br />the appeal decision from the City. <br /> <br />15. The appeal officer’s decision is final and is not subject to further administrative review or <br />appeal. <br /> <br />16. Documents filed in connection with the Fair Rate of Return Appeal may be subject to <br />disclosure pursuant to the California Public Records Act (Gov. Code, § 7920.000 et. seq) or <br />other applicable local, state, or federal law (collectively, “Public Disclosure Laws”). Do not <br />include any personal identifying information (such as Social Security numbers and account <br />numbers) in any documents submitted to the City with the appeal. If such information is <br />included, ensure it is properly redacted. <br /> <br />17.
