Conduct a public hearing; and <br />2. Waive the second reading and adopt an ordinance amending Redwood City <br />Municipal Code Chapter 15 (Smoking Regulations) to (1) repeal in their entirety <br />Article III (Tobacco Retail Permit) and Article V (Prohibiting the Sale of Flavored <br />Tobacco, Electronic Cigarettes, and the Sale of Tobacco Products in <br />Pharmacies), (2) adopt by reference Title 4, Chapter 4.98 of the San Mateo <br />County Ordinance Code in Article III, and (3) amend Article I, Section 15.2 <br />(Definitions). <br /> <br />CEQA: <br />The adoption of this Ordinance is not subject to the California Environmental <br />Quality Act (CEQA) pursuant to CEQA Guidelines (Cal. Code Regs., tit. 14, div. 6, <br />ch. 3) section 15060 because the activity is not a Project as defined in CEQA <br />Guidelines section 15378 (no potential for resulting in physical change in the <br />environment). In the event that this Ordinance is found to be a Project under <br />CEQA, it is exempt from CEQA review pursuant to the “common sense <br />exemption” under CEQA Guidelines section 15061(b)(3) because it can be seen <br />with certainty that there is no possibility that the activity in question may have <br />a significant effect on the environment.
