C.It accommodates the required affordable units. It will <br />accommodate the proposed 75 affordable units which is <br />3 times more than the 25 affordable units required. <br />D.It is consistent with the Housing Element, General Plan, <br />and Zoning. See Attachment 4. <br />E. It will not cause residential segregation because 100% of <br />the units will be affordable and they will be located <br />adjacent to other multi family residential and high <br />density residential uses that are served by nearby <br />neighborhood serving commercial uses. <br />C. Adequate Size The Land Donation Site is approximately 0.54 acres (23,363 sq. <br />ft.), and is sufficient size to accommodate 75 affordable units <br />based on the current zoning of the site. This meets the <br />requirement that the site accommodate the greater of: 40 units <br />(excluding any replacement unit obligations) or at least 27 units <br />which is 110% of the 25 affordable units that otherwise would <br />be required based on the current zoning of the site. <br />D. Value of Substitute Site The value of the Substitute Site to be donated is $9,880,000 <br />which is greater than the $5,773,437 Impact Fee calculated <br />based on the amount of the fees due on date the entitlements <br />for the Lane Project was approved. <br />E. Site Control As evidenced in the Purchase and Sale Agreement for the <br />Substitute Site dated September 11, 2025 separately submitted <br />to the City, Lane has site control of the Substitute Site. <br />F. Title Report As evidenced in the preliminary title report for the Substitute <br />Site prepared by First American Title Company dated March 24, <br />2026 submitted separately to the City, the site has a “clear” title <br />report and will not be encumbered by any lien securing the <br />repayment of debt or any other security instrument at the time <br />of transfer to Eden. <br />G. Property Transfer Lane will transfer the Substitute Site to Eden who will develop, <br />own and operate the affordable housing development on the <br />Substitute Site consistent with this Affordable Housing Plan. <br />Lane and Eden will ensure that the transfer includes the <br />following: <br />•Recordation of an affordable housing restrictive <br />covenant that includes one or more of the following be <br />provided to the City - right of reverter, right of first <br />ATTY/RESO.0052/ CC RESO APPROVING SUBSTITUTE SITE AS AFFORDABLE HOUSING SITE (705 VETERANS)(1900 BROADWAY DA) - EXHIBIT 1 <br />REV: 07-21-26 MI <br />Page 10 of 53
