Upon the construction of any new residential building (three (3) units or less), the overhead services <br />servicing the building shall be undergrounded. This may require design, permitting, and construction <br />outside of the property boundary. In lieu of the underground requirements for the overhead services <br />associated with the construction of a new residential building, a developer may pay a fee, as <br />established by resolution of the City Council, into the City's Utility Undergrounding Fund. Said fee will <br />not exce ed the costs associated with the required undergrounding. The City Engineer shall have the <br />discretion to grant hardship exception to this requirement based on the following factors, including, <br />but not limited to: whether there is sufficient rights/interest/title for the undergrounding, location <br />of the nearest pole(s), and location of existing improvement(s) along proposed route of underground <br />conduits. <br />C. Upon the substantial remodeling of a commercial building, the existing and new electrical, <br />telephone, and cable TV lines connected to the building will be installed underground. <br />DB. All existing below ground electrical, telephone, communications, and cable TV lines shall remain <br />below ground, including all replaced services and frontage infrastructure. <br />EC. This Section will not apply to undergrounding required as part of a subdivision or other permit <br />approval, nor will it apply to new residential buildings in which one hundred percent (100%) of the <br />units are subject to an affordable housing deed restriction. <br /> <br />ARTICLE XV. – TRANSPORTATION IMPACT FEE <br />[Only changes to Section 18.252] <br />Sec. 18.252. EXEMPTIONS AND CREDITS: <br />A. Any claim of exemption from the impact fee shall be made no later than the time of application for <br />a building permit. Any claim not so made shall be deemed waived. The following shall be exempted <br />from payment of the impact fee: <br />1. Alterations or expansion of an existing building where no additional dwelling units are created, <br />where the use is not changed; <br />2. The construction of accessory buildings or structures which will not generate additional <br />vehicular trips over and above those generated by the principal building or use of the <br />development and which will not be used for other than storage; <br />3. The replacement of a destroyed or partially destroyed building or structure with a new building <br />or structure of the same size and use; provided, that no additional trips will be generated over <br />and above those generated by the original use of the land to which the new development <br />pertains; <br />4. Development that does not result in any additional vehicular trips as determined by the <br />Administrator; <br />5. Publicly owned facilities; <br />6. Pursuant to Government Code Section 65852.2(f)(3) 66311.5(c), accessory dwelling units of less <br />than seven hundred fifty (750) square feet; and
