/0,40 <br />• Permitted Uses: Professional beauty supply stores are not listed as <br />permitted uses in Article 26, Section 2. <br />• Accessory Uses: Professional beauty supply stores do not qualify <br />as accessory uses to art galleries pursuant to Article 26, Section 3 <br />in that professional beauty supply stores do not constitute any of <br />the following: <br />A. Incidental storage and office uses; <br />B. Day care centers; or <br />C. Incidental instruction services in conjunction with a primary <br />use. <br />• Conditional Uses: Professional beauty supply stores are not listed <br />as conditional uses in Article 26, Section 4. Article 26, Section 4.S <br />provides for "other uses that are not otherwise listed" in Article 26, <br />which are determined to be (1) of the same general character as <br />the uses permitted by Article 26; and are determined to be (2) not <br />inconsistent with the purpose of Article 26. The Zoning <br />Administrator determined that the proposed professional beauty <br />supply store is not of the same general character and is <br />inconsistent with the purpose of Article 26: <br />(1) General Character of Uses Permitted by Article 26 All of <br />the first -floor permitted and conditionally permitted uses listed <br />in Article 26, Sections 2 and 4 allow for members of the <br />population at large to patronize the various business <br />establishments by purchasing goods and /or services. The <br />proposed professional beauty supply store is available only to <br />a very limited subset of the community, specifically licensed <br />cosmetologists. Thus, the proposed use is not of the same <br />general character since the permitted and conditionally <br />permitted first floor uses allowed in the downtown Central <br />Business Retail Zoning District core do not require a special <br />license to purchase goods and /or services. <br />(2) Purpose of Article 26 : The proposed professional beauty <br />supply store was found not to be consistent with the purpose <br />of the CBR Zoning District, Article 26, Section 1. Article 26.1 <br />states that the purpose of the CRB Zoning District is "to <br />concentrate retail uses downtown which will serve the needs <br />of Redwood City residents, businesses, and workers." The <br />proposed professional beauty supply store is proposed to <br />have products and services available to only licensed <br />cosmetologists, and not to Redwood City residents, <br />businesses, and workers in general. Consequently, the <br />proposed use is not consistent with the purpose of Article 26 <br />based on the use's limitation of patronage to only licensed <br />cosmetologists. <br />
