6.1 G
Page 22
Response
The Gily disagrees partially with the finding. While the number of red light
violation-related collisions at the approaches hae nofi had a significant
change since fihe installation of the red light cameras, it woufd appear#he
City's camera systems are reducing the number of red light violations as
the number of vioiations recorded have dropped since fiheir installation. 1fi
is hoped the cameras are a deterrent and drivers are beeaming educated
to become more cognizant ofraffic control signals.
Findtng #7
Most cities are protected from losses by a "cosneutral"elause in fheir confracts.
!n the event that fine revenue received does not cover fhe monthly cosf of the
contract, he cty is only required to pay fhe actual amount fhaf idid recerve. San
Carlos anc!San Mafeo among other clties have voluntariy nullifiec!fhe "cost
neufra!"clause in their contracts following a recent court case where a cifation
issued with this clause in place was dismissed by the cour.
Response
The City agrees with the finding. The City's contract does have such a
clause and is working to nullify the cost neutrlity (ause in its contract.
Fndig#
4 significant porion of fhe citations issuecfrom red light cameras are for motorist
faiure to stop before making a right hand turn. The same fine s appied to bath
violations.
Response
The City agrees with the finding. The City is unaware of the number of
violafiions for faiEure to stop before making a right turn in other cities;
however a significant portion of citations issued from fihe City's red tight
cameras are for thafi iolation. Bear in mind that red (ight turns against a
red light present a danger to drivers, bicyclists, and pedesfrians which is
the reason why it is iliegai in the State ofi California.
Finding #9
The ne for failure fo stop before makrng a rght hand turn seems aut of
proportion fo similar offenses and as a result is oten appealed fo the traffic courf.
The state mandatecfine in 2070 for failure fo stop at a stop signal or fai/ure fo
halt before turning right or a red Cight is $446.00. 7raffic School is an acditional
$fi0.00. By confrast, the fine for failure to half aa sfop sign is $24.00; and fhe
fine for going 5 mph over ffe speec!limit is $274.0.
Response
The City partially disagrees with the finding. First, the State, and not the
City, sets the amounts of fines and assessments for traffic violations. As
5
