The Board hereby finds, determines and concludes as
follows:

(a) The Project would be built in the same location and
would involve the installation of essentially the same equipment
as was proposed in 1990. It would be developed in two phases.
The first phase would not process oil/water mixtures, hence the
Project's name does not describe its Phase I functions. In
addition, the name of the Project sponsor has changed, but the
principal in charge of the operation of the Project is the same
person. These changes are considered minor, non-substantive,
changes in the Project and the SEIR.

(b) The Soils and Geology impacts would be the same as
described in the SEIR, although the mitigation for clean-up from
an accidental spill must be applied to Phase I as well as to the
ultimate Project. This is accomplished with a revision to the
applicable mitigation measure.

(c) The Air Quality analysis remains applicable to the
Project now ~roposed. However, additional information is supplied
based on the Project Sponsor's application to the San Francisco
Bay Area Air Quality Management District ("BAAQMD") for an
Authority to Construct and a Permit to Operate.

(d) The water related impacts also remain applicable to the
Project. The requirement for a National Pollutant Discharge
Elimination System ("NPDES") permit for disposal of rainwater

3
