<br />when an emergency will not permit a delay, and when certain actions and expenditures <br /> <br />are necessary to respond to the emergency; and <br /> <br />WHEREAS, on August 25, 2010, a ruptured sewer force main caused sewage to <br /> <br />flood a segment of paved street, flow into homes in the vicinity of Davit Lane and <br /> <br />Anchor Circle in Redwood Shores, and flow into the Redwood Shores lagoon; and <br /> <br />WHEREAS, on September 1, 2010, the City Manager declared a local <br /> <br />emergency because the ruptured sewer force main in the area of Davit Lane and <br /> <br />Anchor Circle in Redwood Shores and in the Redwood Shores lagoon constitutes a <br /> <br />threat to life, health, property, and essential public services, and the public interest and <br /> <br />necessity demand that the City immediately expend funds to repair and clean up from <br /> <br />the rupture without soliciting or advertising for bids; and <br /> <br />WHEREAS, specific actions necessary to prevent or mitigate an emergency are <br /> <br />exempt from CEQA (Public Resources Code section 21080(b)(4), and section 15269(c) <br /> <br />of the Guidelines). <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />REDWOOD CITY, AS FOLLOWS, <br /> <br />1. The City Council confirms the City Manager's proclamation that a local <br /> <br />emergency exists in the area of Davit Lane and Anchor Circle in <br /> <br />Redwood Shores, and within the Redwood Shores lagoon. <br /> <br />2. The City Council finds based on substantial evidence that the public interest <br /> <br />and necessity demand the immediate expenditure of public money to <br /> <br />safeguard life, health, property, and essential public services, and that <br /> <br />the emergency will not permit a delay resulting from a competitive <br /> <br />A TTY IRESO/RESO.2049 <br />090710 <br /> <br />2 <br />
