<br />7.B <br />Page 176 <br />and may be subject to further negotiations as it. relates to the Development Agreement <br />established for the Peninsula Park project. <br /> <br />Q9 <br /> <br />General Plan and Zoning Compliance: Prior to the MSV project, the subject property <br />had a General Plan designation of Office/Commercial - Office Park Oriented Uses. As <br />part of the MSV approvals, the General Plan was amended and the land use <br />designation was changed to Office/Commercial - Mixed Use (Commercial and <br />Residential), As indicated above, this portion of the MSV project was not subject to the <br />voter referendum; therefore, the Peninsula Park project and subsequently the One <br />Marina project is consistent with the current General Plan designation of <br />Office/Commercial - Mixed Use Residential. <br /> <br />Zoning for the project site was changed from General Commercial (CG) to Precise Plan <br />(P) with the adoption of the Peninsula Park Precise Plan, The One Marina project has <br />been submitted with the intent of fully complying with the previsions of the Peninsula <br />Park Precise Plan. Pending confirmation by the Planning Commission of several <br />interpretations, the project as submitted would be consistent"with the existing zoning <br />regulations. <br /> <br />Environmental Review: An Environmental Impact Report (ErR), prepared for the City by <br />Wagstaff and Associates, evaluated the potential effects of MSV and was certified by <br />the City in 2004, More specifically, the Redwood City Planning Commission certified the <br />Final Environmental Impact Report (Final EIR) for the Marina Shores Village project in <br />July 2003, and the City Council approved the Precise Plan and its land use entitlements <br />in June 2004 and made 28 Statements of Overriding Consideration in taking their <br />action,1 The Marina Shores Village approval was repealed through a local voter <br />referendum in November 2004, The certification of the Final EIR was not part of the <br />referendum. <br /> <br />As previously discussed, the Peninsula Park application included a portion of the same <br />project area as MSV with a similar mix of land uses at a lower density and lower <br />heights. The City has determined that an Addendum to the previously certified EIR was <br />the appropriate environmental review document for the Peninsula Park project, pursuant <br />to Sections 15164 and 15162 of the California Environmental Quality Act (CEQA) <br />Guidelines. The purpose of an Addendum is to describe the changes and additions to <br />the previously certified EIR necessary to achieve CEQA compliance for the proposed <br />Peninsula Park project. The Addendum identifies mitigation measures that have been <br />removed as a result of the reduced project scope, mitigation measures that remain <br />applicable, and the impacts that continue to be significant and unavoidable. <br /> <br />Prior to the submittal of the One Marina project the applicant obtained a legal opinion <br />from the law firm Meyers Nave regarding the consistency of the propose project with the <br />Precise Plan and whether the revised project was within the scope of the 2003 ErR and <br />Addendum. The City received a separate legal opinion from McDonough Holland & <br />Allen, Both legal opinions came to the independent conclusion that a revised project <br />with a reduced scope and scale, such as that represented in the One Marina project, <br /> <br />1 Resolution No. 14590 dated 6/7/04 <br />
