(d) Providing that Kainos' insurance coverage shall be primary insurance with <br /> respect to City, its Council, officers, boards, commissions, employees, and <br /> agents, and any insurance, self- insurance or joint self- insurance <br /> maintained by City for itself, its Council, officers, boards, commissions, <br /> employees, or agents shall be in excess of Kainos' insurance and not <br /> contributory with it. <br /> 6. NON - DISCRIMINATION <br /> In addition to the non - discrimination requirements set forth in <br /> Paragraph K of Exhibit B, Kainos shall comply with the more specific non- <br /> discrimination requirements described below: <br /> a. Section 504 of the Rehabilitation Act of 1973. <br /> (1) Pursuant to Section 514 (Public Law 93 -112), Kainos agrees <br /> that no otherwise qualified persons with disabilities shall, <br /> solely by reason of a disability, be excluded from the <br /> participation in, be denied benefits of, or be subjected to <br /> discrimination in connection with Kainos' performance of this <br /> Agreement, including in the selection of persons eligible to <br /> rent the Affordable Bedrooms. <br /> (2) Compliance with Section 504 of the Rehabilitation Act of 1973, <br /> as amended, requires that all benefits, aids and services are <br /> made available to persons with disabilities on an equivalent <br /> basis with those received by non - disabled persons. Kainos <br /> shall agree to be in compliance with Section 504 requirements <br /> by developing a plan for compliance to be submitted to the <br /> City- designated Section 504 Coordinator as soon as possible <br /> but not later than the Close of Escrow. <br /> b. Affirmative Action. Kainos certifies that it is in compliance with the <br /> Equal Employment Opportunity Requirements of Executive Order <br /> No. 11246, as amended by Executive Order No. 1375, Title VII of the <br /> Civil Rights Act of 1964, the California Fair Employment Practices Act <br /> and any other federal or state laws pertaining to equal employment <br /> opportunity, and that it will not discriminate against any employee or <br /> applicant for employment or opportunity to purchase the Dwelling or <br /> rent Affordable Bedrooms therein on the basis of race, religion, color, <br /> national origin, ancestry, sex, age, physical or mental disability, <br /> marital status, sexual preference, or political affiliation in matters <br /> pertaining to occupancy, hiring, training, upgrading, transfers, <br /> compensation or termination. <br /> ATTY /AGR/2010.083 5 <br /> 091610 <br />
