6. NON - DISCRIMINATION <br />Contractor shall comply with the non - discrimination requirements <br />described below: <br />A. Section 504 of the Rehabilitation Act of 1973. <br />(1) Pursuant to Section 514 (Public Law 93 -112), the Contractor <br />agrees that no otherwise qualified persons with disabilities <br />shall, solely by reason of a disability, be excluded from the <br />participation in, be denied benefits of, or be subjected to <br />discrimination in the performance of this contract or in the <br />selection of low income tenants to occupy the affordable <br />units to be preserved on the Property. <br />(2) Compliance of Section 504 of the Rehabilitation Act of 1973, <br />as amended, requires that all benefits, aids and services are <br />made available to persons with disabilities on an equivalent <br />basis with those received by non - disabled persons. <br />Contractor shall agree to be in compliance with Section 504 <br />requirements by developing a plan for compliance to be <br />submitted to the Section 504 Coordinator as soon as <br />possible but not later than by the close of escrow for the <br />refinancing of the Property. <br />B. Affirmative Action <br />Contractor certifies that it is in compliance with the Equal <br />Employment Opportunity Requirements of Executive Order No <br />11246, as amended by Executive Order No 1375, Title VII of the <br />Civil Rights Act of 1964, the California Fair Employment Practices <br />Act and any other federal or state laws pertaining to equal <br />employment opportunity, and that it will not discriminate against <br />any employee or applicant for employment or opportunity to <br />purchase the dwelling to be built on the Property on the basis of <br />race, religion, color, national origin, ancestry, sex, age, physical or <br />mental disability, marital status, sexual preference, or political <br />affiliation in matters pertaining to occupancy, hiring, training, <br />upgrading, transfers, compensation or termination. <br />C.
