M U 9 <br />ancestry, sex, age, physical or mental disability, marital <br />status, sexual preference, or political affiliation. Contractor <br />agrees to take affirmative action to ensure that applicants <br />are employed, and that employees are treated during <br />employment, without regard to their race, religion, color, <br />national origin, ancestry, sex, age, physical or mental <br />disability, marital status, sexual preference, or political <br />affiliation. Such action shall include, but not be limited to the <br />following: employment, upgrading, demotion or transfers; <br />recruitment or recruitment advertising; layoff or termination; <br />rates of pay or other forms of compensation; and selection <br />for training, including apprenticeship. Contractor agrees to <br />post in conspicuous places, available to employees and <br />applicants for employment, notices to be provided by the <br />Agency setting forth the provisions of this Fair Employment <br />Practices section. <br />(2) The Contractor agrees to permit access to its records of <br />employment, employment advertisements, application <br />forms, and other pertinent data and records by the State Fair <br />Employment Practices Commission, or any other agency of <br />the State of California designated by the awarding authority, <br />for the purposes of investigation to ascertain compliance <br />with the Fair Employment Practices section of this contract. <br />D. Nondiscrimination Based on Disability. <br />Contractor hereby agrees that it will comply with the provisions of <br />Section 504 of the Rehabilitation Act of 1973, as amended, <br />providing equal access and reasonable accommodations in <br />employment programs and services to persons who are disabled. <br />E. Interest of Public Officials <br />No members, officers, employees, or agents of the Agency or the <br />City and no member of the Agency Board and of the City Council <br />and no other public official who exercises any function or <br />responsibility with respect to this Agreement or Contractor's <br />Program during his or his tenure, or for one year thereafter, shall <br />have any interest, direct or indirect, in this contract or a related <br />subcontract, or the proceeds thereof. Contractor shall incorporate <br />in all subcontracts hereunder a provision prohibiting such interest. <br />3/3,'2003 6 <br />
