(0.1 F,- <br />2.12 Highly Compensated Employee <br />A Participant who is a Highly Compensated Employee as defined in Section 125 (e) of <br />the Code. <br />2.13 Key Employee <br />A Participant who is a Key Employee of the City as defined in Section 416(i)(1) of the <br />Code. <br />2.14 MERP <br />The Medical Expense Reimbursement Plan attached hereto as Appendix C. <br />2.15 Participant <br />Any individual who participates in the Plan in accordance with Section III hereof. <br />2.16 Plan <br />The Flexible Benefit Plan as set forth herein, together with any and all amendments and <br />supplements hereto. <br />2.17 Plan Year <br />The calendar year. <br />2.18 Premium Contribution Plan <br />The Premium Contribution Plan attached neretc s Appendix B. <br />2.19 Oualified Benefits <br />Any benefits offered by the City that are excluded from the Participant's income under a <br />specific provision of the Code and authorized for inclusion in the Plan by Section 125 of <br />the Code, and benefits offered by the City with respect to a Domestic Partner. <br />2.20 Salary Reduction Ajreement <br />The agreement between the Participant and the City pursuant to Section 4.3 under which <br />the Participant elects to have salary reduction contributions made to the Plan. It is <br />sometimes referred to as an election form. <br />
