Adis <br />Legislative Bill Action <br />................................ ............................... <br />Status: AsEnvSafe&ToxMat; Hearing 4/29, Posi- <br />tion: Support. <br />SB 312 (Machado) Urban Landscape Water <br />Conservation Ark. The League is seeking <br />comments from cities about whether the criteria in <br />this bill that communities must meet to qualify for <br />an exemption are appropriate. SB 312 would <br />require the Department of Water Resources to <br />update the model local water efficient landscape <br />ordinance. It also would establish a process for <br />cities to adopt their own ordinance or the model <br />ordinance. Senator Machado's office and the bill's <br />sponsors have been extremely gracious and has <br />worked diligently with League staff to identify and <br />address key concerns with SB 312. However, two <br />outstanding issues remain. First, the League is <br />investigating whether separate meter require- <br />ments are actually necessary for new and rehabili- <br />tated landscape larger than 5,000 square feet, and <br />for more than 1 acre of irrigated land. Second, SB <br />312 would not require communities that meet <br />specific criteria to adopt a water efficiency ordi- <br />nance. (Amended <br />4- 10 -03) Long range .50 BMG caliber weapons <br />are among the most destructive and powerful <br />legally available in the United States which can be <br />used to accurately hit targets over a mile away, <br />including chemical and refinery facilities, airplanes <br />and helicopters. AB 50 would regulate the sale <br />and possession of long -range .50 BMG caliber <br />sniper rifles and ammunition in the State of Califor- <br />nia. Specifically, AB 50 would make it unlawful to <br />manufacture, sale, distribute, import or possess a <br />.50 BMG caliber rifle within the State without a <br />permit after July 1, 2004; track the possession of <br />and ownership of .50 BMG rifles in the Prohibited <br />Armed Persons File database; make it an offense <br />for any person to commit an assault upon the <br />person of another or upon the person of a peace <br />officer or firefighter with a .50 BMG rifle; and, <br />create a sentence enhancement for persons who <br />commit or attempt to commit a felony with a .50 <br />BMG rifle. They are capable of inflicting damage <br />up to four miles and have been used by the <br />military to destroy jeeps, tanks, personnel carriers <br />and other vehicles. Police Vehicle Pursuits. <br />(Amended 2 -19-03) AB 74 increases the penal- <br />ties and fines for attempting to evade a peace <br />officer. AB 74 increases the penalty for attempting <br />to evade a peace officer from a six -month misde- <br />meanor to an alternate misdemeanor/felony, <br />punishable by up to one year in county jail or 16 <br />months, 2 or 3 years in state prison; increases the <br />penalty for disregard for persons or property while <br />attempting to evade a peace officer a felony, <br />punishable by two, three or four years in state <br />prison; and, increases the minimum fine for willful <br />or wanton disregard for persons or property while <br />attempting to evade a peace officer from $1,000 to <br />$2,000. AB 74 also increases the penalty for <br />evading a peace officer which results in serious <br />bodily injury from a felony punishable by four, six, <br />or 10 years in state prison and increases the <br />penalty for evading a peace officer which results in <br />death to five, 10 or 15 years in state prison. Vehicles: Peace Officers: <br />Fleeing. (Amended 4-10 -03) . AB 140 sends a <br />strong clear message to deter offenders from <br />attempting to flee law enforcement officers and <br />endanger lives. AB 140 increases penalties for <br />intentionally attempting to evade a peace officer <br />and causing either serious bodily injury or death of <br />another person.
