�3-c <br />(a) The Services shall include, but are not necessarily limited to <br />preconstruction, design services and construction administration for the <br />Public Parking Facility, including all required features (such as, by way of <br />example and not by way of limitation, compliance with the Americans with <br />Disabilities Act, restrooms, elevators, security, and access controls). as <br />well as clearing and grading the Project Site, excavation, relocating the <br />existing City water and sewer mains, demolishing and removing the <br />abandoned reinforced concrete box culvert, relocating storm drain lines, <br />shoring, dewatering, traffic control, and restoring surface improvements. <br />The Services shall include all necessary construction, appurtenances and <br />improvements as reasonably required by the City and Agency to complete the <br />aforementioned Public Parking Facility. <br />Developer shall contract for design services for the Project with professional <br />Architects, Engineers and Surveyors, with valid licenses in the State of California and <br />experienced in performing the Services described hereunder, as identified in Exhibit C. <br />To the extent required by law, Developer and its consultants shall pay prevailing wages <br />as applicable to the Work pursuant to Labor Code Section 1770 et seq. <br />Developer shall submit design documents for review and approval by the City <br />and Agency upon completion of Design Development documents, when the <br />Construction Documents are 50% complete and when the Construction Documents are <br />90% complete. The City and Agency shall have a reasonable time to review the <br />documents within the Schedule. The Developer shall perform all of its obligations <br />hereunder and shall conduct all operations with respect to the performance of the <br />Services in a good, workmanlike and professional manner, with the standards of <br />diligence and care normally employed by duly qualified persons utilizing their best <br />efforts in the performance of comparable work in the San Francisco Bay Area and in <br />accordance with generally accepted practices appropriate to the activities undertaken. <br />Developer shall perform its Services hereunder in full compliance with applicable <br />federal, state and local laws and regulations in effect at the time such services are <br />rendered ( "Applicable Laws "). <br />F:Atty /Agr/Agr.119 <br />050803 3 <br />
