9-A-10 <br />Legislative Bill Action <br />................................ ............................... <br />The following are summaries of just a few of the legislative bills that are currently being acted upon <br />by the League of California Cities. Public Works Contracts. <br />Compensation of Contractors. The League and <br />ACWA are on record as opposed to this bill. If <br />any city has written a letter of opposition, please <br />send your letters to the League. AB 453 seeks to <br />change Califomia statutory and case law that have <br />been in place for at least a century. It provides <br />that if a contract with a public agency is declared <br />void, then no payments can be made under it. <br />The current law can be harsh at times, it has <br />served both the state and local agencies very well <br />over the decades. Competitive bidding laws exist <br />to benefit and protect the taxpaying public, not for <br />the benefit and enrichment of bidder. AB 453 1s <br />similar to AB 750 (Brewer), which was vetoed in <br />1998 by the Governor. <br />AB 453 passed out of the Business and <br />Professions Committee 8-0 on 4/29/03. Staff: <br />Natasha Fooman, Status: AsApps, Position: <br />Oppose. <br />AB 792 (Yee). Vehicles. Removal. Stor- <br />age. AB 792 expresses the intent of the Legisla- <br />ture when it required all vehicles storage facilities <br />to accept valid bank credit cards. The <br />Legislature's intent was to assist vehicle owners <br />or their agents to make such payments for towing <br />and storage services and expedite the recovery of <br />towed vehicles to promote the safety and welfare <br />of the public. By allowing payment by credit card <br />for vehicle towing and storage services is an <br />important safety regulation because it decreases <br />the likelihood that a vehicle owner will be stranded <br />without the use of his or her vehicle. The sponsor <br />of the bill is the City and County of San Francisco. <br />AB 792 passed out of the Assembly Transportation <br />Committee 15-1 on 4/29. Staff. Natasha <br />Fooman, Status: AsmFir, Position: Support <br />SB 848 (Karnette). Vehicles. School Zone <br />Fines. The law enforcement community believes <br />SB 848 would reduce the number of instances <br />where drivers violate the Vehicle code in school <br />zones and would make school zones safer for our <br />children. The bill would double or increase the <br />fines for a designated violation occurring in a <br />specially posted school zone, in any city or county <br />that passes an ordinance. SB 848 passed out of <br />the Senate Transportation Committee on 4/29/03. <br />Staff: Natasha Fooman, Status: SenApps, <br />Position: Support. <br />AB 1011 (Richman). California Twenty-First <br />Century Infrastructure Investment Fund <br />Allocations. AB 1011 provides a formula to <br />allocate funds to state and local government from <br />the prospective California Twenty-First Century <br />Infrastructure Investment Fund (Fund). The fund <br />would be used to meet transportation, water, and <br />park and open space needs across California. <br />AB 1011 consistent with the original intent of ACA <br />11. ACA 11 was passed last year and establishes <br />the California 21 Century Infrastructure Invest- <br />ment Fund, and beginning in FY 04 -05 dedicates a <br />percentage of the growth of the General Fund to <br />meet California's infrastructure needs. AB 1011 <br />passed out of the Assembly Business and Profes- <br />sions Committee 13-0 on 4/29/03.
