6.1 A <br /> was halted after January 31, 2010 due to the start of the California Clapper Rail ne� ng <br /> season, as directed by the U.S. Fish and Wildlife Service. Substantial completion of the <br /> levee work was achieved by January 31, 2010, however, work to resolve "punch IisY' � <br /> items necessarily was halted until the end of the nesting season on September 1, 2010. <br /> The contractor resumed construction work on September 29, 2010, and final completion <br /> I occurred on November 4, 2010. ', <br /> Redwood Shores Levee System Certification Submittals <br /> Concurrent with the efforts to construct the levee improvements, the levee certification <br /> documentation required by FEMA was prepared by Redwood City's consultant, Moffatt <br /> & Nicol. Three separate certification packages were prepared, one each for Redwood ' <br /> City, County of San Mateo, and City of San Carlos, as each agency will be responsible <br /> for maintaining their levee segment. Please see the map attached. <br /> Draft levee certification packages have been sent to FEMA for review. The <br /> requirements for levee certification are outlined in Title 44 Code of Federal Regulations <br /> Part 65.10 and include evaluation of levee freeboard, closures, embankment protection, <br /> slope stability, settlement, interior drainage, and operation and maintenance <br /> procedures. To proceed with the levee system certification process, staff requests <br /> Council approve the submittals and authorize the City Engineer to sign and seal those <br /> documents. <br /> A Memorandum of Understanding (MOU) befinreen San Carlos and Redwood City which <br /> stipulated terms for the improvements to the section of San Carlos` levee was approved <br /> by Redwood City Council on September 14, 2009. Pursuant to the MOU, San Carlos <br /> established an assessment district to reimburse Redwood City for the cost of levee <br /> improvements and to fund future maintenance requirements. San Carlos City Council <br /> approved the levee certification submittal for their levee section and authorized their <br /> City Engineer to sign and seal those documents. Redwood City will forward San Carlos' <br /> submittal to FEMA. <br /> Redwood City was unable to develop a similar Memo of Understanding with County of <br /> San Mateo for improvements to the County's levees. The County adopted the <br /> Operafions and Maintenance Manual for the San Carlos Airport Levee thereby <br /> assuming responsibility for future maintenance of their levee section. However, the <br /> County will not approve, sign and seal the submittal documentation necessary to the <br /> levee system certification process. Pursuant to FEMA's certification procedure, any <br /> California Registered Professional Engineer may sign and seal the submittals. The City <br /> Engineer for Redwood City has determined that both the levee and the certification <br /> package is properly prepared and certifiable. In #he interest of proceeding with the <br /> certification process, staff recommends that Council approve the submittals and <br /> authorize Redwood City's City Engineer to sign and seal the documents relevant to the <br /> County's section of levee. <br /> ALTERNATIVES <br /> Council may choose not to accept the San Carlos Airporf Levee Improvement Project or <br /> authorize the release of bonds and retention which would be contrary to the terms of the <br /> contract, prior Council action, and public contracting code. <br /> Council may choose to not approve one or both of the cert�cation submittals to FEMA <br /> and direct staff to revise the documents. <br />
