Hold Publlc Hearing Regardin8 General Vacation of Public Right-of-Way — il Chemical Way. Ms. Thompson, City Attomey, reported on the items related to Chemical Way. She said the first item was about #he tentative proposed altemate site for the jail outside of the ' down#own area. Ms. Thompson reported that City Council met in Closed Session regarding modifications to the terms for the assignment of the praperties at 20, 50, 70 and 80 Chemical Way. She reportet! that City Council was in favor of the amendments, which , included the contribution of funding to the County and to haVe the City Manager execute the amended MOU (Memorandum of Unders#anding) and have it brought back to Council in January for rat�cation. Motion carried 6-0 with Vice Mayor Aguirre absent by unanimoua voice vote. She said the other item pertained to the conveyance of properiy and vacation of certain properties, as conditions contained in the MOU with the County for the property acquisition. Ms. Thompson reported that the Board of Superv�sors voted today to move forward with the assignment and acquisition of the prope�ties. Ms Thompson said the vacation of Chemical Way was a oondition of the MOU, which the Ci#y had agreed to do subject to certain conditions by the County. She reviewed the vacating process and what City staff has done as was approved by City Council from October 2010. She recommended that if Council does approve the vacation of public right-of-way, and following pub[ic comment, that the City Manager be gNen the authority to sign any documents, subject to City Attorney review, that would be necessary to eff�ctuate the vacation process of Chemical Way.
