• 41 6. Paragraph 7 (b) of Resolution No. 6882 is hereby amended to read as follows: "7. (b) Initial Study. " (1) Requirement. For any project not excepted or exempted from the provisions hereof, the Planning Director shall conduct an initial study in accordance with the guidelines to determine if the project may have a significant effect on the environment unless the Planning Director can determine that the project will clearly have a significant effect. In connection with such study, the Planning Director shall develop a procedure to assist him in making such study which procedure may, but shall not necessarily be limited to, the use of questionnaires, or other information obtaining devices. All applicants shall cooperate with and assist the Planning Director in obtaining information or data as he may require and which is reasonably related to the study to be made by him. The Planning Director may, upon a finding by him that an applicant has failed to cooperate or furnish such information or data, refuse to process further the applicant' s application, and shall notify the applicant in writing of his decision. " (2) Negative Declaration. If the Planning Director determines that a proposed project will not have a significant effect on the environment, he shall prepare, or cause to be prepared under the circum- stances and in the manner set forth in paragraph 7 (c) (3) hereof [relating to the circumstances under which and manner for which environmental documents may be prepared by a consultant under agreement with the City) , a draft written negative declaration with respect thereto, in accordance with CEQA and the guidelines. Upon completion of the draft negative declaration and such consultation with responsible agencies as may pertain thereto, the Planning Director shall give notice of the preparation of the negative declaration to all organizations and individuals who have previously requested such notice, and shall also cause notice of the preparation of such negative declaration to be given in the City' s official news- paper, not less than ten days prior to consideration by the Planning Commission of said negative declaration. The Planning Director shall make the draft negative declaration available for public inspection subject to reasonable requirements, rules, or regulations established by him. Copies of any draft negative declaration, or any portion thereof, shall be made available to any person in accordance with the provisions of Article II of Chapter 1 of the Code of the City of Redwood City and upon payment of the fees therein prescribed. Written comments or other statements with respect to the negative declaration and to the proposed finding that a proposed project will not have a significant effect on the environment -14-
