i "4. FEE SCHEDULE. (a) Fee for Initial Study, Negative Declaration. For any proposed project defined- in paragraph 2 (r) (i) (3) hereof, which is not subject to a categorical or emergency exemption, an applicant shall pay a nonrefundable fee of $100 for an initial study to determine whether the proposed project may have a significant effect on the environ- ment. In the event it is determined that a negative declaration is required for the project, no additional fee shall be assessed unless such declaration is to be prepared by a consultant (see para. 4 (c) , below) . In the event it is determined that an environmental impact report is required for the project, the fee specified in paragraph 4 (b) hereof shall be assessed. The fee specified in this paragraph 4 (a) shall be paid at the time the applicant applies to the City for the issuance of the lease, permit, license, certificate, or other entitlement for use involved with the proposed project. " (b) Fee for Preparation of Environmental Impact Report. For a project which requires the preparation of an environmental impact report, an applicant shall pay the actual cost of prepara- tion thereof as hereinafter provided. Upon determining that an environmental impact report is required for a project, the Planning Director shall calculate the estimated cost of the preparation of such report based upon a rate of $18 per hour for the time consumed in such preparation, from the commencement of work to the completion of the final environmental impact report, by any City employee or employees . Upon notification of the estimated cost of preparation of an environmental impact report, and prior to commencement of work thereon, the applicant shall pay to the City the total sum so calculated. In the event the actual cost as determined upon completion of the final environmental impact report exceeds the sum so deposited, the applicant shall pay the difference upon notification thereof by the City, and in the event said final cost is less than the amount so deposited, the City shall remit to the applicant the difference between said final cost and the amount deposited. " (c) Fee for Preparation by Consultant, Administration Fee. In the event a negative declaration or environmental impact report is to be prepared by a consultant pursuant to the provisions of paragraph 7 (b) (2) , or paragraph 7 (c) (3) , below, the applicant shall pay to the City the total estimated sum for the preparation of such declaration or report prior to the award of the agreement by the City to the consultant. In the event the actual amount to be paid by the City pursuant to such agreement exceeds the sum so deposited, the applicant shall pay the difference upon notification thereof by the City, and in the event said final amount is less than the amount so deposited, the City shall remit to the applicant the difference between the actual amount and the amount deposited upon completion of the environmental impact report by the consultant. "In addition to the foregoing amount to be paid for the preparation of the environmental impact report by a consultant, the applicant shall pay to the City an administration fee in the amount of $100, or ten percent of the actual amount paid by the City to the consultant, whichever is greater.
