i <br /> "4. FEE SCHEDULE. (a) Fee for Initial Study, Negative <br /> Declaration. For any proposed project defined- in paragraph <br /> 2 (r) (i) (3) hereof, which is not subject to a categorical or <br /> emergency exemption, an applicant shall pay a nonrefundable <br /> fee of $100 for an initial study to determine whether the <br /> proposed project may have a significant effect on the environ- <br /> ment. In the event it is determined that a negative declaration <br /> is required for the project, no additional fee shall be assessed <br /> unless such declaration is to be prepared by a consultant (see <br /> para. 4 (c) , below) . In the event it is determined that an <br /> environmental impact report is required for the project, the <br /> fee specified in paragraph 4 (b) hereof shall be assessed. The <br /> fee specified in this paragraph 4 (a) shall be paid at the time <br /> the applicant applies to the City for the issuance of the lease, <br /> permit, license, certificate, or other entitlement for use <br /> involved with the proposed project. <br /> " (b) Fee for Preparation of Environmental Impact Report. <br /> For a project which requires the preparation of an environmental <br /> impact report, an applicant shall pay the actual cost of prepara- <br /> tion thereof as hereinafter provided. Upon determining that <br /> an environmental impact report is required for a project, the <br /> Planning Director shall calculate the estimated cost of the <br /> preparation of such report based upon a rate of $18 per hour <br /> for the time consumed in such preparation, from the commencement <br /> of work to the completion of the final environmental impact <br /> report, by any City employee or employees . Upon notification <br /> of the estimated cost of preparation of an environmental impact <br /> report, and prior to commencement of work thereon, the applicant <br /> shall pay to the City the total sum so calculated. In the event <br /> the actual cost as determined upon completion of the final <br /> environmental impact report exceeds the sum so deposited, <br /> the applicant shall pay the difference upon notification <br /> thereof by the City, and in the event said final cost is less <br /> than the amount so deposited, the City shall remit to the <br /> applicant the difference between said final cost and the <br /> amount deposited. <br /> " (c) Fee for Preparation by Consultant, Administration <br /> Fee. In the event a negative declaration or environmental <br /> impact report is to be prepared by a consultant pursuant <br /> to the provisions of paragraph 7 (b) (2) , or paragraph 7 (c) (3) , <br /> below, the applicant shall pay to the City the total <br /> estimated sum for the preparation of such declaration or <br /> report prior to the award of the agreement by the City to <br /> the consultant. In the event the actual amount to be paid <br /> by the City pursuant to such agreement exceeds the sum so <br /> deposited, the applicant shall pay the difference upon <br /> notification thereof by the City, and in the event said final <br /> amount is less than the amount so deposited, the City shall <br /> remit to the applicant the difference between the actual amount <br /> and the amount deposited upon completion of the environmental <br /> impact report by the consultant. <br /> "In addition to the foregoing amount to be paid for the <br /> preparation of the environmental impact report by a consultant, <br /> the applicant shall pay to the City an administration fee in <br /> the amount of $100, or ten percent of the actual amount paid <br /> by the City to the consultant, whichever is greater.
