(b) Determination of Significant Effect. For any project <br />not excluded or exempted from the provisions hereof, the Planning <br />Director shall determine whether such project may have a signifi- <br />cant effect on the environment. In connection with such deter- <br />mination, the Planning Director shall develop a procedure to <br />assist him in making such determination which procedure may, but <br />shall not necessarily be limited to, the use of questionnaires, <br />or other information obtaining devices. All applicants shall <br />cooperate with and assist the Planning Director in obtaining <br />information or data as he may require and which is reasonably <br />related to the determination-to be made by him. The Planning <br />Director may, upon a finding by him that an applicant has failed <br />to cooperate or furnish such information or data, refuse to process <br />further the applicant's application, and shall notify the applicant <br />in writing of his decision. <br />If the Planning Director determines that a proposed project <br />will not have a significant effect on the environment, he shall <br />prepare a draft written negative declaration with respect thereto, <br />which shall set forth the reasons for his determination. The draft <br />negative declaration shall be reviewed by the Planning Commission, <br />and either confirmed or rejected by the Commission. In the event <br />of rejection, an Environmental Impact Report for the project shall <br />be prepared. In the event of confirmation, the Planning Director <br />shall transmit a copy of the negative declaration to the officer <br />or agency of the City proposing or having the responsibility for <br />proposing, the project if it involves activities defined and des- <br />cribed in paragraph 2 (m) (1) and ( 2) hereof, or having the authority <br />to approve or disapprove the project if it involves activities <br />defined and described in paragraph 2 (m) (3) hereof, and in the latter <br />case, he shall likewise transmit a copy of such declaration to the <br />applicant. <br />The Planning Director shall make a finding that a project <br />may have a significant effect on the environment if any of the <br />WE <br />0 <br />
