CHAPTER 2 <br />• Sections <br />222 The term "voter" means a registered elector if there <br />are any within a district or an improvement district therein; <br />and if none, it means an owner. An owner may vote in person <br />or by his personal representative and either may vote by <br />proxy. <br />223 The term "Resolution of Final Determination" or <br />CHAPTER <br />Se :tions <br />"Ordinance of Final Determination, it means a resolution or <br />ordinance adopted pursuant to Section 17 of Article XIII of <br />the California Constitution by the affirmative votes of 4/5 <br />of the members of the council in which the council finds and <br />determines that the public interest, convenience and necessity <br />require a project or projects for a district or improvement <br />district without further compliance with the provisions of <br />Division 4 of the Streets and Highways Code. <br />CHAPTER 3 <br />INCIDENTAL EXPENSES <br />301 The term "incidental expense" includes any expense or <br />cost incidental to the acquisition, construction, improving, <br />financing, maintenance or operation of any project. <br />302 Acquisition. The cost of title searching, description <br />writing, salaries of right of way agents, appraisal fees, fees <br />incidental to removal of encumbrances, surveys, sketches <br />and other fees and costs related to acquiring lands, improve- <br />ments, easements or rights of way for any project, is an <br />incidental expense. <br />303 Discount, Interest and Capital. The amount of any bond <br />discount, working capital, interest during the period of con- <br />struction and for twelve months thereafter, or bond reserve <br />fund, required to be capitalized for any project, is an in- <br />cidental expense, except that no interest or principal payments <br />of any assessment bonds issued under chapter 10 hereof shall be <br />paid from the proceeds of sale of any such bonds and that no <br />such interest or principal payments shall be an incidental <br />expense in any proceedings under said chapter 10. <br />2 <br />
