TESSENDORFF FOR VARIANCE ALLOW 10' REAR YARD (45 CLAREMONT) The
II regular established setback in this area is 15 feet, and any deviation would estab-
lish a precedent. Mr. Tessendorff called attention to the recent variances on
Arch Street where 5' setbacks were allowed at the rear of medical buildings. Fire
Chief Lodi called attention to the fact that Fire Underwriters check for noncon-
forming instances and the granting of this variance would be non - conforming.
II Building Inspector stated that the Planning Commission was attempting to hold the
setbacks to standard. The Traffic Committee
suggests continuing studies be made and a final report and recommendation be sub-
mitted after reopening of schools, inasmuch as the use of t his crossing by school
children is one of the main factors referred to by petitioners in this matter.
Councilman Spillers stated his opinion that we should not wait until the fall, but
should act now. City Manager called attention to the fact that the Division of High-
, ways base their decisions on traffic counts, and this matter has already been sub-
mitted to them and ,turned down as "not justified".
Mr. Moshell addressed the Council and urged that something be done at once as he
considered this intersection as very dangerous to not only school children but also
to adult pedestrians and automobile traffic.
After further discussion, Councilman Spillers moved that the Council go on record
as favoring signal and signifying their agreement to pay their share of the cost,
approximately one quarter of the total.
