It was further stated that the rear of lots 3 and 4 would be used for a rear <br /> yard for duplex building and would not be used for building purposes. Councilman <br /> Granger was of the opinion that the property should be "tied up" to eliminate the <br /> possibility of any future building by the recording of an agreement. Councilman Royer <br /> moved that the real estate committee make an appraisal on the property in question, <br /> seconded by Councilman Britschgi and carried. <br /> RESOLUTION GRANTING VARIANCE AND AUTHORIZING RECORDING DECLARATION OF RESTRICTION, LAND <br /> DEVELOPMENT COMPANY. The City Attorney explained the Resolution had been prepared incor- <br /> II the understanding of the Council at the public hearing held some weeks ago <br /> and covers the shopping area of the Land Development Company in the Roosevelt-Avenue - <br /> Upton Street area. At the time of t his hearing, Land Development Company agreed to <br /> file a declaration of certain restrictions and would be granted variances to allow <br /> no front and side yard set -backs on certain lots, subject to condition that the con- <br /> struction of buildings be as'submitted tot he Planning Commission. After further <br /> discussion, Councilman Britschgi moved that the matter be held over for one week to <br /> allow the Council to study the map as originally submitted. Motion seconded by <br /> Councilman Granger and carried, Agenda July 11, 1955. <br /> STERLING COMPANY LETTER REGARDING FARM HILLS BOULEVARD. Mr. Herbert Frahm, writing for <br /> Oddstad Homes, states that the traffic conditions on McGarvey Avenue had been brought <br /> to their attention. He states that at the time of conditional approval of the tentative <br /> map by the Planning Commission, the Oddstad Homes had one on record to the effect that <br /> every effort would be made to carry Farm Hills Drive through the Davis property to <br /> Jefferson Avenue. The Company is presently negotiating for the purpose of the Davis <br /> property and if successful, the extension to Jefferson Avenue will be immediately <br /> undertaken._ <br /> In the meantime, Oddstad proposes to record as soon as possible a unit of approximately <br /> 100 homes which would have no other access except through McGarvey. Directly thereafter, <br /> they wish to continue with another 300 homes which would have access to McGarvey and two <br /> additional connections to Upper Jefferson Avenue. Future plans will include continua- <br /> tion to Canada Road. <br /> The general concensus of opinion was that something must be done to aleviate the traffic <br /> problem on McGarvey. It was understood that the map had not been approved, and that <br /> the Company would be expected to come through with a satisfactory route before map can <br /> be recorded. It was suggested that a copy of Mr. Frahm's letter be sent to the Planning <br /> Commission for their information. After a general discussion, Councilman Royer moved <br /> that Mr. Frahm's letter be answered and that he be advised of the thoughts of the Council. <br /> Motion seconded by Councilman Britschgi, and carried. <br /> RECOMMENDATIONS AND SUGGESTIONS, COUNCIL AND DEPARTMENT HEADS: <br /> ,Councilman Stout commented onthe present situation on Jefferson between Middlefield and the <br /> railroad tracks stating that there was some confusion in left turns which should be <br /> eliminated. He had noted several cars making left turns at the service station side and <br /> he wcndered whether or not the motorists had been fully advised of this regulation. <br /> Captain Faulstich stated that this was a matter of enforcement and would require the <br /> posting of an officer in this area.
