hearing be closed, seconded by Councilman Royer and carried. <br /> RESOLUTION 1817 CONFIRMING ASSESSMENT BROADWAY SIDEWALKS was offered by Councilman Granger and <br /> carried on roll call, Councilmen Spillers and Stout noted absent. <br /> PROPOSED REZONING OF BLOCK BOUNDED BY EL CAMINO REAL, CENTER, HEMLOCK AND LINDEN. Hearing was <br /> erroneously held at the December 20th meeting. City Attorney advised that any action taken <br /> should be rescinded by motion. Councilman Royer so moved, seconded by Councilman Granger <br /> and carried. Public Hearing was announced by the Mayor and the affidavit was ordered filed. <br /> Mrs. D. C. Morgan, 34 Center Street, addressed the Council stating that she did not ask for <br /> the rezoning of the entire block but was requesting that the rear portion of her property <br /> adjoining commercial property be rezoned to enable her to build a small modern building <br /> in which she could conduct a cleaning business. The Reverend Sydell Peterson of 142 Center <br /> Street and Mrs. A. Gipsen of 46 Hemlock spoke in favor of Mrs. Morgan's request. Mr. James <br /> Jensen, 325 Linden Street and Mr. Harold Fowler, 101 Park Street spoke against rezoning, <br /> using the increase in traffic which might occur as the principal reason for their objection. <br /> Councilman Granger commented on the present zoning on El Camino Real which under ordinary <br /> circumstances was set at a certain standard depth whereas in other circumstances the area <br /> taken in was a complete street. The distance from El Camino Real to Linden Street is 250 <br /> feet. Councilman Britschgi then noted that the present hearing covers the entire block <br /> whereas the people living in the area apparently did not want that type of rezoning. He <br /> suggested that the Council deny the present recommendation of the Planning Commission and <br /> that Mrs. Morgan return to the Planning Commission and have them consider her case separ- <br /> ately. Councilman Britschgi then moved that recommendation of the Planning Commission <br /> to rezone the entire block be denied, seconded by Councilman Granger., City Attorney ad- <br /> vised that the Council could introduce an ordinance at this time, rezoning any portion of <br /> the block without returning to the Planning Commission. Councilman Britschgi after further <br /> discussion withdrew his original motion with the consent of the second and then moved that <br /> all protests be overruled and the hearing closed. Motion seconded by Councilman Granger <br /> and carried. Councilman Britschgi then moved that the Planning Commission recommendation <br /> be overruled, seconded by Councilman Granger and carried. After further discussion Coun- <br /> cilman Royer moved that a letter be written to the Planning Commission setting forth the <br /> action of the Council and calling attention to the amount of property which was included <br /> in the original rezoning, it being apparent that some property had been over - looked at the <br /> time the area was rezoned. Motion seconded by Councilman Jones and carried. Mrs. Morgan <br /> was advised that she could return to the Planning Commission without paying an additional <br /> 1 fee. <br /> PUBLIC HEARING ADOPT ORDINANCE RELATING TO PARKING DISTRICT PROCEEDINGS. City Attorney Currie <br /> stated that this ordinance as published was incomplete, a substitute ordinance having been <br /> furnished by Attorney Ernest Wilson. It is necessary that this revised ordinance be re- <br /> introduced and published. Councilman Britschgi questioned whether or not it would be pos- <br /> sible to make any changes in the Parking District should it become necessary in order to <br /> substitute certain properties or areas and was advised the entire subject would come up for <br /> hearing on February 7th at which time necessary changes in the Dustrict could be ordered. <br /> Councilman Royer then moved introduction of the revised ordinance, seconded by Councilman <br /> Jones and carried. <br />
