Co- <br /> uncilman Jones moved that the matter be continued for two weeks, seconded by <br /> Britschgi and carried. City Attorney was instructed to prepare Resolution rezoning the <br /> II area from E1 Camino Real to Center, to Linden, to Woodside Road, excluding the three homes <br /> on Center Street, but including the rear of Mrs. Morgan's property. <br /> PUBLIC HEARING - PLANNING COMMISSION RECOMMENDATION TO DENY L. BROWNSTEIN APPLICATION TO REZONE <br /> LOTS 1 AND 2, 'BLOCK 21, REDWOOD HIGHLANDS FROM R -1 AND R -2 to R -2 (Brewster, Elwood and <br /> 1 Fulton). Affidavit of publication and mailing of notice of public hearing was ordered <br /> filed by the Mayor. The City Clerk read a petition containing 34 names of residents in <br /> the area involved, protesting rezoning of Lot 2 from R -1 to R -2. Mr. Eugene Majeski, <br /> Attorney, appeared in behalf of Mr. Brownstein reviewing application for rezoning this <br /> property in 1952, at which time the Planning Commission recommended that the entire area <br /> from James to Brewster be rezoned to R -2. This was approved by the Council, and the City <br /> Attorney was instructed to prepare Resolution to that effect on 9/18/52. Ordinance was <br /> introduced and passed. Lot No. 2 was not included in the legal description, although the <br /> map of the area carried out the line along the Planning Commission's recommendation. Mr. <br /> Majeski stated that an error had been made in the legal description which excluded Lot #2, <br /> keeping it in R -1 Zone. Mr. Pierce Coombes, property owner at the northwest corner of <br /> Fulton and Brewster, appeared, stating that he has owned two lots there for the past 30 <br /> years, and is most interested in keeping property on Brewster in the R -1 zoning, stating <br /> that the lots in question face Brewster and not Elwood. Mrs. Beatrice Clyne Saunders, <br /> owner of Lots 3, 4 and 5, corner of Brewster and Fulton, appeared opposing the rezoning <br /> of these lots. Mr. Majeski suggested that the lots in question be resubdivided to face <br /> Elwood if that would permit the rezoning. Councilman Granger, who has lived in that area <br /> for the past 30 years, stated that he understood that it was the intention to come up to <br /> the Andrews property and stop there. Mr. N. Kuykendall, 180 Elwwod, who owns three lots <br /> north of Brewster on Elwood, stated that the original wording of the petition was to rezone <br /> the lot from James to Brewster facing on Elwood Street, at that time, it did not include <br /> the lots on Brewster Street. One of the lots on the corner of Brewster and Elwood facing <br /> Brewster was in error zoned to R -2. Mrs. Leah Clark, 1?3 Fulton, stated that she bought <br /> her property with the thought that this was first class residential area and wishes to <br /> keep it in that standing. Councilman Britschgi moved that Public Hearing be closed, sec- <br /> onded by Councilman Stout and carried. Councilman Granger moved that the recommendation <br /> of the Planning Commission be upheld and the application be denied, seconded by Councilman <br /> Spillers and carried on roll call. <br /> PUBLIC HEARING - PLANNING COMMISSION RECOMMENDATION TO DENY PERATA & FARRAR APPLICATION TO RE- <br /> ZONE PORTION OF BLOCK 5, TRACT 559, REDWOOD MANOR FROM R -2 TO C -1 -H. Mr. Perata, 402 Middlefield Road, appeared appealing the Council to <br /> permit'the•rezoning. He called the Council's attention to the island at the intersection <br /> which he claimed to be a definite eyesore. Mr. Mackelroy, 3639 Florence, appeared and <br /> stated that they didnot want any rezoning up at that end of the area. He said that the <br /> area from Marsh up to 17th Avenue was rezoned, and that some of the rezoned property was <br />
