There being no protests, oral <br /> or written, Councilman Britschgi moved that Public Hearing be closed, seconded by Coun- <br /> cilman Jones and carried. City Attorney Currie presented the prepared Ordinance to the <br /> Council. Councilman Jones moved introduction of Ordinance, seconded by Councilman Brit- <br /> schgi and carried on roll call. <br /> ADOPTION OF ORDINANCE TO REZONE LOT 12, BLOCK 1, AMENDED MAP OF TERRACE SHOPPING CENTER. <br /> Affidavit of publication was ordered filed by the Mayor, who opened the Public Hear- <br /> ing. There being no protests, written or oral, Councilman Stout moved that Public <br /> Hearing be closed, seconded by Councilman Britschgi and carried. Councilman Stout <br /> moved adoption of ORDINANCE NO. 600.51, seconded by Councilman Britschgi and carried <br /> on roll call. City Attorney advised the Council that Ordinance placing the rezoned <br /> territory in Fire Zone No. 2 was ready for introduction. Councilman Jones moved intro- <br /> duction of Ordinance, seconded by Councilman Stout and carried. <br /> REPORT OF THE YACHT HARBOR COMMITTEE. COUNCILMAN BRITSCHGI REPORTED THAT THE COMMITTEE CON- <br /> SISTING OF AL ONETO, IRVING GOLD, CITY MANAGER ROLISON, PORT MANAGER McCARL, AND MR. <br /> W. W. HILTON, HAD TURNED DOWN THE MASTER PLAN OF THE PORT COMMISSION. The City Engineer <br /> was instructed to prepare map designating the amount of land that they feel would be <br /> necessary for the use of a good Yacht Harbor. This map was presented to the Council. <br /> Councilman Britschgi moved that the map be referred to the Port Commission as Exhibit <br /> A for further study and recommendation back to the Council at the meeting of April L.th, <br /> seconded by Councilman Granger and carried. Ex -mayor Hilton examined the amp and was <br /> in agreement with the above. <br /> CITY ENGINEER JAIN RE: CONFERENCE WITH POST OFFICE OFFICIALS RE: PARKING DISTRICT NO. 1. <br /> City Clerk read the letter from the City Engineer stating that a meeting had been held <br /> with the Post Office Department regarding the request of the City for acquisition of a <br /> 12 foot strip of land between the Main Post Office and the City Library to provide widen- <br /> ing for the proposed Jefferson Avenue Entrance to Parking Lot VII. The Post Office <br /> officials were willing to recommend the granting of a quit claim deed or revocable per- <br /> mit subject to the following conditions: <br /> 1. City to relocate existing privet hedge along present alley, <br /> or plant new hedge. <br /> 2. City to assume public liability for palm trees adjacent to <br /> proposed entrance and walkway, and to assume responsibility for <br /> trimming trees to prevent hazard to pedestrians or vehicular <br /> traffic. <br /> 3. City to relocate sprinkler system in lawn adjacent to entrance. <br /> 4. City to relocate power service poles and circuits, or construct <br /> new underground services to the Post Office. <br /> 5. City to construct a four foot cyclone type fence along the rear <br /> of the Post Office property to prevent users of the parking lot <br /> from trespassing on the Post Office grounds. <br /> City Engineer recommended that the conditions be concurred in by the City Council. Coun- <br /> cilman Jones moved that the Engineer's report be accepted and that the Council concur in <br /> the recommendation of the City Engineer. After discussion regarding the legality of pro- <br /> cedure, Councilman Jones restated his motion approving City Engineer's recommendation sub - <br /> jeet to the legal aspects of the procedure, seconded by Councilman Britschgi and carried. <br /> City Attorney advised the Council that approving the acquisition of the property will re- <br /> quire more fornal action, and that the City Council is in effect the Board of Directors <br /> of the Parking District and that any matter regarding the District must come to the Coun- <br /> cil. <br />
