1 <br /> g^!n <br /> PUBLIC HEARING - ANNEXATION HIGHLANDS TERRITORY NO. 3 (FARM HILLS). Affidavit of publication <br /> was ordered filed. Col. Weiss appeared before the Council protesting the annexation, bas- <br /> ing his protest on the development of some five hundred homes which will involve additional <br /> water mains and sewer problems, since the City is reaching the point where the present sewer <br /> treatment plant is reaching its maximum capacity. If five hundred homes are built, the cost <br /> of enlarging the plant will run to considerable amount. He also stated that the subdividers <br /> have suggested an alternate site for reservoir which the State Department and Health Depart- <br /> ment does not approve of. The building of the additional homes may result in the necessity <br /> of building a new fire station. Col. Weiss requested that this matter be laid over until <br /> such time as a clear and definite proposal is presented so that the people can know whether <br /> or not it is advantageous to annex. After further discussion regarding recreation facili- <br /> ties, Councilman Spillers moved that public hearing be closed, seconded by Councilman Jones <br /> and carried. Assistant City Attorney Lebsack informed the Council that the only thing be- <br /> fore the Council was the annexation, and the subdivision would be considered later. Coun- <br /> cilman Spillers offered Ordinance for introduction approving the annexing of Highlands <br /> Territory #3, (Farm Hills), seconded by Councilman Britschgi and carried. <br /> ADOPTION OF ORDINANCE ESTABLISH FIRE ZONE LOT 2, BLOCK B, W. W. & M. (Garfoli). Affidavit of <br /> publication was ordered filed by the Mayor. Assistant City Attorney advised the Council <br /> that this is a follow -up from meeting of March 21st when lot was rezoned from R -I.. to C -1 -H. <br /> The area is now placed in Fire Zone #1 as recommended by Fire Chief. Councilman Britschgi <br /> moved public hearing be closed, seconded by Councilman Royer and carried. Councilman Brit- <br /> schgi offered Ordinance for adoption, seconded by Councilman Spillers and carried on roll <br /> call. <br /> REPORTS: <br /> CITY MANAGER REPORT ON FRIENDLY ACRES WATER SYSTEM. Report of the City Manager was presented to <br /> members of the Council, and read by City Clerk indicating a net profit of Friendly Acres <br /> Water System at $3,020.99 for the Calendar Year 1953. Should the City purchase the system <br /> it would be necessary to bring the system up to standard at considerable expense. Council- <br /> man Britschgi moved that the report be accepted and referred to the City Council for fur- <br /> ther study, seconded by Councilman Spillers and carried. <br /> CITY MANAGER REPORT ON STATUS OF PARKING DISTRICT #1. City Manager Rolison stated that the <br /> work is progressing according to schedule. Assistant City Attorney remarked that there <br /> are some thirty -seven parcels of land that have to be acquired yet. He advised that the <br /> legal aspects will probably take over two months. City Engineer stated that plans for the <br /> culvert have been sent to the State Department for approval and upon approval we can pro- <br /> ceed. The subject of an inspector for the project was discussed and the City Engineer in- <br /> formed the Council that he will endeavor to secure the best inspector possible. Council- <br /> man Granger suggested that if the City Attorney's office is pressed for- time to handle this <br /> matter, the Council should authorize his office to employ outside attorneys in order to <br /> hasten completion of the legal aspects. Councilman Britschgi suggested that the City Mana- <br /> ger check with the different Department Heads involved, and if extra help is needed in <br /> either the City Attorney's office or City Engineer's office, he will report back to the <br /> Council with such information for the Council to take action. <br /> CITY MANAGER REPORT ON PROPOSED ANNEXATION BREWSTER AVENUE RESERVOIR. City Manager Rolison ad- <br /> vised that annexation was possible by annexing portion of street which would result in the <br />
