303 <br /> HIGHLANDS TERRITORY NO. 5. Letter from Fire Chief Lodi read which_states_ that the area <br /> adjoins recently annexed territory. Streets that already exist are dead -ended and plan <br /> lines to permit cul -de -sac should be insisted upon in the future. In this case, it appears <br /> to be practically impossible to arrive at such a solution, therefore, the Fire Department <br /> has no objection to the annexation now under discussion. City Attorney Currie reported <br /> that a letter had been circulated in which the property owners indicated that they would <br /> not request utilities until such time as same are available. Three of the property owners <br /> signed this agreement, one withholding action at this time. Mr. Currie advised the Coun- <br /> cil that if the annexation is completed, there is no obligation that the City will have to <br /> develop adequate sewer or water facilities other than at the expense of the property owner <br /> by forming an assessment district. Mr. George Wimmer appeared and stated that he is anx- <br /> ious to come in to the City as he works for the Fire Department and it is necessary that <br /> he live within the City. The City Attorney advised that the Smith property could be elimi- <br /> - nested from the area under consideration. Councilman Granger moved that the necessary steps <br /> - be taken to annex all of the area except Lots 9 and 10, seconded by Councilman Spillers. <br /> Councilman hoyer offered amendment to the motion referring the matter to the City Attorney <br /> who will include Lots 9 and 10 if the Smiths will sign. Councilman Granger stated that <br /> there appears to be no objections from the Official Family provided the people who do not <br /> sign are excluded. Motion seconded by Councilman Stout, City Attorney to report in one <br /> week. Mr. Quadt wanted to be assured that he be allowed to connect in to the sewer line <br /> which will be installed adjacent to his property. Motion carried. <br /> CITY COLLECTOR REPORT ON RECENT AUCTION SALE AT 1612 EL CAMINO REAL. Mr. Paul Perrin, City Col- <br /> lector, reported that the purpose of the auction was to raise funds and was conducted in <br /> full accordance with Ordinance. Councilman Britschgi suggested that this report be referred <br /> to the City Attorney to suggest new methods of tightening up on this particular procedure <br /> of sale. Councilman Britschgi so moved, seconded by Councilman Granger and carried. <br /> MISCELLANEOUS <br /> BUILDING INSPECTOR AND FIRE MARSHAL REPORT ON INSPECTION BUILDING AT 32 LUCERNE AVENUE. The re- <br /> port of Building Inspector and Fire Marshal indicates that the building would not conform <br /> to the building code and could not be moved. Councilman Britschgi suggested that it might <br /> be feasible to open Geneva to Hess Road which would result in leaving the house on Lucerne. <br /> City Engineer was directed to prepare plans including the opening of Lucerne, however, and <br /> after further discussion, it was decided to continue as decided. <br /> PROPOSED MOVING BOOT BLACK STAND TO GREYHOUND DEPOT SITE. Mr. Jones appeared requesting per- <br /> mission to move to the Greyhound Depot. He had a letter from the Bus Company stating that <br /> he may move there if he complies with certain stipulations which he has agreed to. Coun- <br /> cilman Royer moved that the building be allowed to be moved to the Greyhound Bus area, sec- <br /> onded by Councilman Spillers. Councilman Granger requested that the permit be revokable <br /> permit for one year, along the lines stipulated by the bus company. Mr. Bud Stevenson <br /> adressed the Council protesting the location of this building at the Greyhound Depot site <br /> as did Councilman Jones. After some discussion regarding the appearance and improvement <br /> of the building, the motion was Harried on roll call, Councilman Jones and Mayor Herkner <br /> voting NO. <br />
