3 4 <br /> RECOMMENDATIONS AND SUGGESTIONS . <br /> COUNCILMAN JONES BROUGHT UP THE MATTER OF THE REAL ESTATE OPERATORS SELLING PROPERTY IN THE <br /> EMERALD LAKE DISTRICT WITHOUT ADVISING THE BUYER THAT WATER CONNECTIONS CANNOT BE OB- <br /> TAINED. Councilman Jones moved that the City Clerk write a letter to the Real Estate <br /> Board informing them of the Council's policy in the matter of water connections in the <br /> Emerald Lake area, seconded by Councilman Stout. There was discussion regarding said <br /> policy and the past deviations in certain areas, after which motion carried. <br /> COUNCILMAN ROYER REQUESTED A HEARING FOR MR. DUKE, WHO WAS IN THE AUDIENCE, REGARDING HIS <br /> REQUEST FOR BUILDING PERMIT ON HIS PROPERTY ON CANYON ROAD. Planning Commission had <br /> granted him a use permit subject to certain conditions which Mr. Duke claimed he had <br /> complied with. In order to allow additional space for sontemplated widening of Canyon <br /> Road and allow his house to set far enough back he had purchased a 5' strip from his <br /> neighbor. In the belief that his request had been allowed he had made all financing <br /> arrangements with the F.H.A. and the bank only to be informed that he could not proceed. <br /> City Engineer Jain called attention to the fact that he had recommended holding up Mr. <br /> Duke's request until plans which were being prepared by an outside engineer for sewer <br /> installation were available. Several months ago he had recommended that Breeze Place <br /> be extended to Canyon Road, which would intersect Mr. Duke's lot. The Planning Commission <br /> will consider at their April 26th meeting the proposed extension of Breeze Place. Coun- <br /> cilman Royer stated that in his opinion Mr. Duke was entitled to consideration inasmuch <br /> as he had offered to secure bond of $2,000.00 to guarantee paying for his share of the <br /> sewer assessment, had spent considerable money in the preparation of plans and had in <br /> general complied with all conditions. Councilman Spillers, of the same mind, moved that <br /> permit be granted, seconded by Councilman Royer. City Engineer Jain expressed his opin- <br /> ion that the widening of Canyon Road should be kept in mind and the best method of widen- <br /> ing would be to acquire all of the frontage necessary on Mr. Duke's side rather than equal <br /> frontages on both sides of the road. This method would make it unnecessary to acquire and <br /> tear down a structure on the high side. Councilman Granger requested information as to <br /> why the City Engineer had not reported back to the Council as requested some months ago <br /> to which City Engineer replied that he was still waiting for plans and profiles from the <br /> outside engineer. After further discussion, Councilman Stout offered an amendment to the <br /> original motion to the effect that the matter be held up for one week, the City Manager <br /> to bring back a report and recommendation together with the recommendation of the City <br /> Engineer. The matter of the proposed widening was to be included in City Manager's re- <br /> port. Motion was seconded by Councilman Britschgi and carried on roll call, Councilmen <br /> Royer and Spillers voting NO. <br /> COUNCILMAN STOUT MOVED THAT COMMISSIONERS HANLEY, BEAL AND SHULTZ, WHOSE TERMS ARE EXPIRING <br /> ON THE PARK AND RECREATION COMMISSION, BE REAPPOINTED TO THE SAME POSITIONS, seconded by <br /> Councilman Britschgi and carried. <br /> COUNCILMAN STOUT INVITED THE COUNCIL AND WHOEVER WISHES TO MAKE A TOUR THROUGH THE WESTINGHOUSE <br /> PLANT. This will be taken up at the next study meeting to decide on a date and time. <br /> COUNCILMAN GRANGER SUGGESTED THAT IT WOULD BE FITTING IF THE CITY CLERK WOULD WRITE TO THE <br /> COUNCIL IN BURL INGAME expressing our sympathy over the loss of their Mayor. This is <br /> in the form of a motion, seconded by Councilman Spillers and carried. <br /> SINCE COUNCILMAN STOUT WILL BE UNABLE TO ATTEND THE PLANNING COMMISSION MEETING ON TUESDAY <br /> APRIL 26, 1955, Councilman Britschgi will attend. <br />
